THE COMPREHENSIVE PLAN FUTURE LAND USE MAP INDICATES THE PROPERTY IS PLANNED FOR RESIDENTIAL USES.

THE REQUESTED LAND USE IS VEHICLE IMPOUND FACILITY FOR A FENCED IMPOUND LOT, IN ADDITION TO WHAT IS AN EXISTING AUTO REPAIR BUSINESS.

IN THE DEFINITION. IN THE ZONING ORDINANCE, A VEHICLE IMPOUND FACILITY MEANS A FACILITY THAT PROVIDES FOR TEMPORARY SCREEN STORAGE OF OPERABLE OR INOPERABLE VEHICLES TO BE CLAIMED BY TITLE HOLDERS OR THEIR AGENTS, OR THOSE THAT ARE AWAITING VEHICLE INSURANCE ADJUSTMENTS AND OR CLAIMS. SO THE EXISTING BUSINESS ON SITE IS A BUSINESS CALLED FAMILY AUTO AND TOWING LLC.

AND THIS WOULD BE IN ADDITION TO THAT BUSINESS.

AND THE REQUEST IS FOR TEMPORARY STORAGE OF TOWED VEHICLES INSIDE WHAT IS ALREADY A FENCED AREA.

AND THIS IS A GOOGLE STREET VIEW IMAGE OF THE, OF THE PROPERTY.

AND YOU CAN SEE THE, THE CURRENT BUSINESS THERE WITH CARS PARKED AND BEING WORKED ON AND, AND TRUCKS.

AND THE ANTICIPATED OFF SITE IMPACTS WOULD BE MINIMAL TRAFFIC AND VISIBILITY FROM OLD STAGE ROAD RIGHT OF WAY, AS WELL AS ADJACENT PROPERTIES AND VARIOUS CONDITIONS ARE RECOMMENDED BY STAFF WHICH ARE INTENDED TO REDUCE OR MITIGATE THOSE IMPACTS.

VDOT NOTED THAT OLD STAGE ROAD HAS AN AVERAGE ANNUAL DAILY TRAFFIC COUNT OF 3500 VEHICLES PER DAY, AND THAT THE EXISTING COMMERCIAL ENTRANCE ON THE SITE MEETS THEIR STANDARDS.

AND THEY HAVE NO OBJECTION. THE BUILDING INSPECTIONS OFFICE NOTED THAT THEY SHOULD COORDINATE WITH POLICE AND FIRE AND EMS TO ENSURE SAFE EMERGENCY ACCESS PRIOR TO OPERATING THE IMPOUND FACILITY. THIS IS A PUBLIC HEARING AND WAS ADVERTISED IN ACCORDANCE WITH THE STATE CODE, AND NO WRITTEN COMMENTS OR FORMAL COMMENTS WERE RECEIVED FROM THE PUBLIC.

STAFF'S RECOMMENDATION IS APPROVAL SUBJECT TO THE RECOMMENDED CONDITIONS.

BUT TO SUMMARIZE THE CONDITIONS, THE FIRST ONE WOULD BE TO LIMIT THE SIZE, SCOPE, AND LOCATION OF THE IMPOUND LOT TO WHAT IS JUST SHOWN ON ON THE APPLICANT'S DRAWING ON THE CONCEPTUAL PLAN.

AND THEN THERE'S A CONDITION ABOUT THE MAINTENANCE OF THE FENCING AROUND THE PERIMETER FOR THE DURATION OF THE FACILITY'S LIFETIME.

AND THEN A CONDITION ABOUT THE SCREENING. THAT ONE, I'LL READ THAT ONE.

THE VEHICLE IMPOUND FACILITY SHALL BE SCREENED FROM PUBLIC RIGHTS OF WAY, ANY OCCUPIED DWELLING IN ANY ABUTTING RESIDENTIALLY ZONED PROPERTY, INCLUDING RA ZONED PROPERTY. THE SCREENING MAY CONSIST OF OPAQUE FENCING, EVERGREEN TREES OR ANY COMBINATION TO INCLUDE EXISTING SITE VEGETATION, MASONRY WALLS OR ANY EXISTING STRUCTURES.

THE APPLICANT SUBMITTED THE FAMILY SUBDIVISION PLAT FOR REVIEW, WHICH SHOWS THE PROPOSED SUBDIVISION OF ONE PARCEL INTO TWO PARCELS.

WE DENIED THAT PLAT DUE TO THE FACT THAT THEY DID NOT COMPLY WITH THAT CODE SECTION OF THE SUBDIVISION ORDINANCE.

THE WAIVER CRITERIA REVIEW IS THAT ON A WHOLE, NO, IT IS NOT AN UNUSUAL SITUATION.
