GOOD EVENING, COMMISSIONERS, THIS IS SUBDIVISION WAIVER # SW-25-02, WHICH IS A REQUEST TO WAIVE STANDARDS CONTAINED IN ARTICLE VII, WHICH IS THE DESIGN STANDARDS OF THE SUBDIVISION ORDINANCE AS AUTHORIZED UNDER SECTION 70-208, TO PERMIT A SUBDIVISION OF ONE LOT INTO TWO LOTS WITHOUT ADHERING TO ALL THE DESIGN STANDARDS OF ARTICLE VII. IT'S IN THE RURAL CONSERVATION AREA. AND HERE YOU CAN SEE A SATELLITE VIEW CLOSER IN ON THE PROPERTY. IT'S CURRENTLY VACANT RESIDENTIAL.

AND THIS IS A SCREENSHOT ZOOMED IN OF THE SUBDIVISION PLAT CURRENTLY UNDER REVIEW, WHICH SHOWS DOWN THE MIDDLE THE PROPOSED LOT LINE, AND THEN AN IRREGULAR SHAPE OF WETLANDS THAT CROSSES THAT LINE, AND TAKES UP A PORTION OF BOTH PROPOSED LOTS.

THERE'S JUST A A GOOGLE STREET VIEW PHOTO OF THE PROPERTY.

AND AGAIN, JUST TO SUMMARIZE THE REQUEST, IT'S TO SUBDIVIDE A ROUGHLY 11 ACRE LOT INTO TWO SMALLER LOTS FOR THE PURPOSE OF BUILDING TWO SINGLE FAMILY DWELLINGS.

AND THE CODE SECTION THAT'S REQUESTED TO BE WAIVED STATES A SHARED ACCESS EASEMENT SHALL BE PROVIDED FOR ALL RESIDENTIAL LOTS POSTED ON AND OR HAVE DIRECT ACCESS TO COLLECTOR ARTERIAL ROADS.

ON COLLECTOR OR ARTERIAL ROADS, ONLY ONE RESIDENTIAL DRIVEWAY CURB CUT SHALL BE ALLOWED FOR EACH THREE RESIDENTIAL LOTS.

THE SHARED ACCESS EASEMENT REQUIREMENT SHALL NOT EXEMPT ANY LOT FROM THE REQUIREMENT TO HAVE PUBLIC STREET FRONTAGE.

AND AS YOU KNOW, THE CRITERIA FOR PLANNING COMMISSION APPROVAL OF THIS SECTION FOR SUBDIVISION WAIVERS INCLUDES, IN CASES OF UNUSUAL SITUATIONS OR WHERE STRICT ADHERENCE TO THE GENERAL REGULATIONS WOULD RESULT IN SUBSTANTIAL INJUSTICE OR HARDSHIP, AND THAT NO WAIVER SHALL BE GRANTED WHICH IS ILLEGAL OR WHICH WOULD PREJUDICE THE HEALTH AND SAFETY OF THE COUNTY CITIZENS.

SO THE APPLICANT'S KEY POINTS OF JUSTIFICATION FOR THIS SUBDIVISION WAIVER OF THE REQUIREMENT, IS THE PRESENCE AND LOCATION OF WETLANDS BETWEEN THE TWO LOTS AND THAT INSTEAD OF ONE DIVERGING SHARED ENTRANCE, TWO SEPARATE DRIVEWAY ENTRANCES WOULD AVOID DISTURBING THESE SENSITIVE ENVIRONMENTAL FEATURES.

JUST SOME MORE STAFF COMMENTS. VDOT ALSO REGULATES ENTRANCES, BUT THE COUNTY AND VDOT ENFORCES THESE REQUIREMENTS INDEPENDENTLY.

AND THE PRELIMINARY PLAT GENERALLY COMPLIES WITH THE REMAINING ZONING AND SUBDIVISION ORDINANCE REQUIREMENTS.

AND BEFORE THAT PLAT COULD BE APPROVED, IT WOULD HAVE TO STILL FOLLOW ALL THE REST OF THE REQUIREMENTS.

AND SINCE WAIVERS WERE FIRST AUTHORIZED IN DECEMBER OF 2007, ZERO WAIVERS OF THIS SAME REQUIREMENT HAVE BEEN APPROVED. THERE HAS ALSO BEEN ZERO REQUESTS FOR THIS REQUIREMENT.

SO THIS IS THE FIRST OF ITS KIND. AND WE'VE REVIEWED AGAINST THE CRITERIA AND FOUND THAT IT'S UP TO THE PLANNING COMMISSION TO DECIDE WHETHER IT MEETS THE CRITERIA OF A WAIVER.

AGAIN, IT'S UP TO THE PLANNING COMMISSION TO DECIDE WHETHER IT MEETS THE DEFINITION OF UNUSUAL SITUATION OR SITUATION WHERE STRICT ADHERENCE WOULD RESULT IN INJUSTICE OR HARDSHIP.

AND IF THE PLANNING COMMISSION FINDS THAT TO BE THE CASE, WE ASK THAT THEY STATE WHAT THAT HARDSHIP IS OR INJUSTICE.

AND STAFF NOTES THAT THIS APPEARS TO MEET THE CRITERIA, BECAUSE THE LOCATION OF WETLANDS ON THE PROPERTY MAKES IT DIFFICULT TO MEET THE SHARED ENTRANCE REQUIREMENT, AND WE'VE PROVIDED A SAMPLE MOTION FOR YOU IN YOUR PACKETS.

THERE DOES NOT APPEAR TO BE ANYTHING ILLEGAL ABOUT THIS REQUEST, OR ANYTHING, WHICH WOULD PREJUDICE THE HEALTH AND SAFETY OF THE COUNTY'S RESIDENTS.

STAFF RECOMMENDS ONE CONDITION, WHICH IS THE REQUESTED PARCEL MAY BE SUBDIVIDED INTO TWO LOTS, WITH ONE PRIVATE ENTRANCE FOR EACH PARCEL. WE'RE DEALING WITH SOME WETLANDS THAT LIE RIGHT IN THE MIDDLE OF THE PROPERTY LINE WHERE WE. THE PROPOSED PROPERTY LINE IS PLANNED TO BE BETWEEN THE TWO PARCELS. WE'RE JUST LOOKING TO HAVE TWO SEPARATE ENTRANCES COMING OFF OF LOVING UNION ROAD RATHER THAN A SHARED ENTRANCE, JUST TO AVOID, YOU KNOW, CUTTING THROUGH THE WETLANDS.

I JUST WANT TO EXPLAIN FOR THE RECORD HERE ON THE CIP PROCESS THAT YOU KNOW, THE COUNTY SUSPENDED THE PROCESS BACK IN 2022 DURING COVID AND DUE TO LIMITED AVAILABILITY OF FINANCIAL RESOURCES FOR BORROWING FOR PROJECTS. AND HAS NOW REACHED A POINT WHERE IT'S LOOKING TO RESTART THE PROCESS.

THE COMMITTEE IS BEING FORMED AS WE SPEAK. IT'S GOING TO BE A VERY SHORT RUN FOR THE COMMITTEE.

JUST TO MAKE IT CLEAR, THE COMMITTEE IS GOING TO COMPLETE ITS BUSINESS PROBABLY BY NOVEMBER.

SO THE MEETING IS GOING TO START RELATIVELY QUICKLY, I THINK PROBABLY MID TO LATE SEPTEMBER THROUGH OCTOBER AND POSSIBLY IN NOVEMBER.

SO IT'S RELATIVELY QUICK. I THINK I'VE NOT SEEN A FINAL SCHEDULE, BUT THE DRAFT I'VE BEEN LOOKING AT, LOOKS LIKE THE COMMITTEE IS GOING TO BE WEEKLY FOR FOUR WEEKS, KIND OF HOW IT LOOKS LIKE IT'S GOING TO LAY OUT WHEN THAT GETS DONE.

AS YOU KNOW, THERE ARE TWO MEMBERS OF THE PLANNING COMMISSION. THIS PROCESS, YOU KNOW VARIES A LITTLE BIT FROM THE ONE IN BACK IN 2022.

JUST TO BE CLEAR, THERE'S A FIVE YEAR CIP. NOT A TEN.

AND SO WITH THAT, I'LL JUST BE GLAD TO ANSWER ANY QUESTIONS THE COMMISSIONERS MAY HAVE REGARDING THE THE MEMBERSHIP AND CERTAINLY LOOKING FOR THE TWO NOMINATIONS FOR THE CIP COMMITTEE. WELL, WILL A LOT OF THESE CIP PROJECTS WOULD JUST BE CARRIED OVER FROM WHAT WAS IN THE PAST? I THINK WHAT HAS BEEN ASKED IF WE'RE GOING TO GO BACK AND LOOK AND SEE WHAT WAS ON THE THE OLD CIP, BUT TO TO ASSUME THINGS HAVE CHANGED SO MUCH TO START FRESH.

NOW, THOSE PROJECTS THAT ARE OUT THERE THAT ARE STILL VALID, WOULD LIKELY BE AFFORDED THE WAY IT'S GOING TO WORK.

A VARIETY OF DEPARTMENTS LIKE SCHOOLS, ETC. THEY'LL SUBMIT CIP APPLICATIONS THROUGH THE CIP COMMITTEE.

SO ANYONE WHO HAD EXISTING PROJECTS THAT ARE, YOU KNOW, BACK THERE, THEY WOULD TAKE A LOOK AT THOSE AND SEE IF THEY'RE STILL APPROPRIATE TO SUBMIT FOR THE NEW CIP, BUT THEY'RE NOT GOING TO AUTOMATICALLY FLOW, OR THIS WILL BE A NEW LIST.

AND HOPEFULLY WE'LL GET SORT OF TO THE END OF THE MODIFICATIONS AND EDITS CHANGES THAT ANYONE MIGHT HAVE SO THAT THE BERKELEY GROUP CAN FINISH ANY FINAL EDITS THAT WOULD LEAD TO THE PUBLIC HEARING THAT WOULD BE SCHEDULED FOR THE PLANNING COMMISSION IN NOVEMBER AT YOUR NOVEMBER MEETING, AND THEN TO THE BOARD OF SUPERVISORS IN DECEMBER.

AND SO ANYWAY, THAT'S SORT OF THE SCHEDULE. I THINK THAT'S HOPEFULLY A GOOD WORK SESSION.

RIGHT NOW, WE THINK THAT'S GOING TO PROBABLY COME TO THE PLANNING COMMISSION PROBABLY SOMETIME AFTER THE FIRST OF THE YEAR. WE DON'T HAVE A SPECIFIC DATE, BUT WE'RE GOING TO LOOK FOR MAYBE LIKE FEBRUARY OR SOMETHING LIKE THAT TO SEE THOSE CODE AMENDMENTS COME ALONG.
