AGAIN, JUST TO SUMMARIZE SOME BACKGROUND HERE, THE PROPERTY WAS REZONED IN 1990 FROM A-1 TO M-2, AND THE PROFFERS WERE AMENDED TO CHANGE THE USE IN 1995 AND WERE AGAIN AMENDED IN 2021 TO CHANGE THE USE.
CURRENTLY, THE APPLICANT IS REQUESTING TO AMEND THE PROFFERS TO ALLOW AUTOMOTIVE SALES AS AN ACCESSORY USE TO THE PRIMARY USE THAT'S ALREADY EXISTING AS CONTRACTOR AND METAL ROOFING FABRICATION AND TO ALLOW ADDITIONAL PERMITTED USES.
HERE'S THE ACTUAL SUBMITTED PROFFER STATEMENT WHICH SHOWS A LIST OF USES WHICH ARE WHICH WOULD BE PROHIBITED SOME SCREENING AND BUFFERING STANDARDS, AS WELL AS THOSE RULES FOR THE AUTOMOTIVE SALES.
SO, THE PLANNING AND ZONING DEPARTMENT FOUND THE LAND USE TO BE CONSISTENT WITH THE COMP PLAN AND SURROUNDING ZONING AND SURROUNDING LAND USES, IN THE ANTICIPATED OFF SITE. IMPACTS VARY BY THE USE OF THE PROPERTY, AND WE STAFF RECOMMENDS ACCEPTANCE OF THE PROPOSED PROFFERS. THE ADDITIONAL DEPARTMENTS AND AGENCIES THAT HAD COMMENTS, ONE OF WHICH WAS VDOT. THEY HAD NO OBJECTION TO THE PROPOSED REZONING.
AND NOTED THAT THE SITE IS ALREADY ACCESSED BY A COMMERCIAL ENTRANCE THAT MEETS VDOT STANDARDS, AND THE BUILDING OFFICIAL NOTED THAT ANY ALTERATIONS TO STRUCTURES WOULD REQUIRE MEETING THE STATE BUILDING CODE.
NO COMMENTS WERE RECEIVED PRIOR TO THIS HEARING AND STAFF RECOMMENDS APPROVAL SUBJECT TO THE PROFFERED CONDITIONS, FOR THE FOLLOWING FINDINGS. THAT IT'S CONSISTENT WITH THE COMP PLAN, CONSISTENT WITH SURROUNDING ZONING AS WELL AS LAND USES.

SO YES, IT IS CONSISTENT WITH SURROUNDING ZONING AND COMPATIBLE WITH SURROUNDING LAND USES.
THE APPLICANT SUBMITTED PROFFERS WHICH WOULD RESTRICT THE POSSIBLE USES OF THE PROPERTY.
AND STAFF RECOMMENDS ACCEPTANCE OF THOSE PROPOSED PROFFERS.
VDOT PROVIDED COMMENTS THAT THEY HAVE NO OBJECTION TO THE PROPOSED REZONING, AND THAT THERE'S ALREADY A COMMERCIAL ENTRANCE, AND ECONOMIC DEVELOPMENT STATED THAT THEY SUPPORT THE SITE PLAN THAT WOULD FURTHER ECONOMIC DEVELOPMENT IN THE COUNTY.

AND THEN THERE ARE NO PROPOSED FACILITIES AT THIS TIME.
SO THE COUNTY IS NOT REVIEWING ANY APPLICATIONS OR ANYTHING.
SO WHAT THAT LEADS TO IS THAT THERE'S 4603 OR 4600, I'M SORRY, 4123 ACRES WORTH OF SOLAR FACILITY OUT THERE IN THE COUNTY AND IN THE COUNTY'S ADOPTED SITING POLICY.
THAT LEAVES A LIMIT, I'M SORRY, A REMAINING ACREAGE BEFORE A LIMIT IS REACHED OF 480 ACRES.
SO THE COUNTY IS TRYING TO CLARIFY THIS FOR EVERYONE.

THE BOARD IN 2025. KNOWING THE AMOUNT OF FACILITIES THAT HAVE ALREADY BEEN APPROVED EXPLAINED THEIR DESIRE TO REDUCE THE ACREAGE REMAINING TOWARD THE CAP TO ZERO.
SO BASICALLY, TO CLOSE THE DOOR ON NEW FACILITIES UNLESS THEY'RE ZONED TO M3.
AND SO, THEY PROVIDED THAT GUIDANCE TO STAFF ON APRIL 22ND.
AND THIS IS THE COMPREHENSIVE PLAN UPDATE. SO, BECAUSE YOU'RE THE SITING POLICY GIVES GUIDANCE WHEN REVIEWING AND CONSIDERING A NEW FACILITY. AND THEN THE ZONING ORDINANCE IS FOR IMPLEMENTING THE REGULATIONS OF THE COUNTY.
SO JUST AND IN THE PACKET, THERE IS A RED LINE VERSION OF THE CHANGES RED LINE AND BLUE.
SO RED LINE IS I THINK THAT WAS GETTING RID OF THE TEXT IN BLUE WAS ADDING NEW TEXT.

SO, THE GUIDANCE FOR THE SITING IN THAT POLICY, AGAIN, IN THE CURRENT POLICY, IT SAYS THAT M3 IS THE PREFERRED LOCATION.
AND SO THAT'S WHAT LED TO THOSE FACILITIES BEING PROPOSED OUTSIDE OF THAT.
THAT'S WHY THE PEOPLE CONTINUE TO PROPOSE FACILITIES IN R-A AND A-1 ZONING DISTRICTS.
SO, AT THIS TIME, NOW THAT SOME FACILITIES HAVE BEEN APPROVED THIS NEW POLICY WOULD CLEARLY STATE THAT M-3 ZONING DISTRICT IS THE ONLY LOCATION FOR SOLAR FACILITIES IN PRINCE GEORGE'S COUNTY FOR NEW ONES.
IF THERE ARE TO BE ANY ADDITIONAL ONES. SO, REGARDING THE ACREAGE CAP IN THE CURRENT POLICY, WE WENT OVER HOW THERE'S THERE IS ESSENTIALLY AN ACREAGE CAP, WHICH SUGGESTS THAT THE COUNTY COULD ACCEPT MORE FACILITIES OUTSIDE OF THE ZONING.
AT NO TIME WAS THE COUNTY EVER OBLIGATED TO ACCEPT A NEW FACILITY.
IT'S JUST A GUIDANCE. BUT IN ORDER TO CLARIFY THE COUNTY'S CURRENT DESIRE FOR NO MORE FACILITIES THAN THOSE LOCATIONS, THE NEW POLICY WOULD CLEARLY STATE THAT NO MORE ARE DESIRED UNLESS THEY'RE ZONED M-3 AND HAVE A SPECIAL EXCEPTION.

THE POLICIES AGAIN WERE TARGETED AT OUTSIDE M-3 ZONING FOR THE FIRST POLICY, AND THE NEW POLICY UPDATED VERSION WOULD BE FOR, YOU KNOW, THE REVERSE OF THAT SITING AGREEMENTS.THIS IS THOSE ARE SPECIAL AGREEMENTS THAT CAN BE SIGNED BETWEEN A COUNTY AND A SOLAR DEVELOPER REGARDING NEW FACILITIES. AND THOSE AGREEMENTS WERE NOT ADDRESSED IN THE CURRENT POLICY, WHICH HAS LED TO SOME CONFUSION OF HOW TO HOW TO DEAL WITH THOSE, AND THE REVISED POLICY WOULD ADDRESS THOSE IN GENERAL TERMS SO THAT THE COUNTY KNOWS WHAT TO DO WHEN THOSE DO COME AROUND.
IF SOMEONE DOES ASK TO TO DISCUSS ONE OF THOSE AGREEMENTS.
AND THEN THE DETAILED DESIGN STANDARDS, THE CURRENT POLICY HAS A LOT OF DETAILED DESIGN STANDARDS, AND THEY ARE ALL THEY WERE ALL DESIGNED WITH PUBLIC INPUT FOR PROPERTIES THAT WERE ZONED R-A AND A-1.
SO, THEY HAVE VERY LARGE BUFFER DISTANCES. THEY WERE MEANT TO, TO, TO DEAL WITH THOSE WHEN THEY WERE PROPOSED IN, YOU KNOW, RURAL OR SEMI-RURAL AREAS. WHEREAS THE REVISED POLICY, SINCE THE COUNTY ONLY WANTS THESE IN M-3 ZONING, IT, IT HAS TO ACKNOWLEDGE THAT CHANGE. AND SO, STAFF IS WORKING TO ADD NEW STANDARDS INTO THE ZONING ORDINANCE.
