I WOULD SAY PROBABLY BETWEEN 8:00 AND 6:00, THERE WOULD BE A FLAGGING OPERATION GOING ON BOTH ON COURTHOUSE AND BULL HILL.
THERE'S STILL DELAYS GOING ON WITH THAT PROJECT.
RIGHT NOW, THE CONTRACTOR IS SHOWING HIS COMPLETION DATE PUSHING OUT UNTIL DECEMBER.
TALKING TO THE CONSTRUCTION MANAGER TODAY, WE FEEL LIKE THAT'S PROBABLY OPTIMISTIC AND THERE ARE CONCERNS.
OUR CONSTRUCTION DIVISION IS WORKING WITH THE CONTRACTOR.
THEY'VE MADE SOME INTERNAL MANAGEMENT CHANGES, AND THAT JUST OCCURRED, AND WE'RE HOPING TO SEE SOME IMPROVEMENTS WITH THOSE CHANGES, BUT THERE ARE CONCERNS THAT GO WITH THE DECEMBER PUSH OUT BECAUSE OF THE WEATHER AND THE ITEMS THAT WILL NEED TO BE COMPLETED DURING THAT TIME FRAME.
I JUST WANT TO BE VERY TRANSPARENT ABOUT THAT NOW, BUT AGAIN, OUR AGENCY AND OUR MANAGERS ARE WORKING TO PUSH THEM AS QUICKLY AS WE CAN AND GIVE THEM THE ASSISTANCE THAT THEY NEED THE BEST THAT WE CAN.

RIGHT NOW, AS THIS SLIDE GETS READY TO COME UP, THERE ARE SEVERAL PROJECTS ON THIS SLIDE AND IT IDENTIFIES THE STATUS OF ALL THE PROJECTS AND SOME OF THE ACTIVITIES THAT ARE ONGOING AND FUTURE THINGS THAT NEED TO BE DONE.
BUT THE TAKEAWAY FROM THAT SLIDE IS THE FIRST THREE ITEMS WE HAVE OBLIGATIONS TO.
WE HAVE TO COMPLETE THOSE PROJECTS.
ALL THREE OF THEM HAVE ENVIRONMENTAL PERMITS THAT ARE STILL OUT THAT WE HAVE TO FULFILL THOSE ENVIRONMENTAL REQUIREMENTS.

THAT WE APPLIED FOR THOSE FUNDS THAT ARE DISTRIBUTED BY DEQ, AND WE GOT THOSE FUNDS WHICH PAY ESSENTIALLY 50% FOR ALL THE DESIGN AND CONSTRUCTION ACTIVITIES FOR THOSE PROJECTS.
TO COMPLY WITH GETTING THOSE REIMBURSEMENT, WE DO HAVE TO COMPLETE THOSE PROJECTS.
FOR THOSE THREE PROJECTS THAT ARE ALL MINOR CORRECTIVE ACTIONS, THE PROJECTS HAVE ACTUALLY BEEN DONE, AND BEEN DESIGNED AND COMPLETED, BUT SOME MAJOR STORMS CAME BY AND CAUSED SOME MORE DISRUPTION IN THOSE AREAS, AND WE HAVE TO GO BEFORE THE PERMIT GETS CLOSED OUT, WE HAVE TO FIX THOSE SMALL AREAS BEFORE WE CAN GET THE REIMBURSEMENT AND CLOSE OUT THAT PERMIT.
THE REMAINING THREE ON THAT SLIDE ARE OPTIONAL.
WE CAN EITHER DO THOSE PROJECTS OR NOT DO THOSE PROJECTS.

WE DO HAVE THE FUNDS AVAILABLE TO BE ABLE TO PAY OUR LAST DEBT PAYMENT, AND WE DO HAVE THE FUNDS AVAILABLE TO COMPLETE THE PROJECTS THAT WE'RE GOING TO BE RECOMMENDING, WITHOUT HAVING TO CHARGE ANOTHER FEE.
THE RECOMMENDATION SATISFIES ALL THE ENVIRONMENTAL COMPLIANCE WITH DEQ, AND AGAINST THOSE THREE PROJECTS, CEDAR CREEK REACH 2, REACH 5, AS WELL AS BURCHETT REACH 1 PHASE ONE.
WE ALSO TRYING TO EXHAUST THE REMAINING FUNDS FROM THE STORMWATER PROCEEDS FROM THE BOND THAT WE RECEIVED YEARS AGO.
IF WE DON'T EXHAUST THOSE FUNDS, WE COULD HAVE POTENTIAL PENALTIES OR FEES THAT ARE GOING TO CONTINUE TO ACCRUE UNTIL WE DO SPEND THOSE FUNDS.

THE ACTIONS WE ARE REQUESTING THIS EVENING AFTER YOU RECEIVE PUBLIC COMMENT DURING A PUBLIC HEARING IS TO APPROVE THE APPROPRIATION OF 3,221,000 IN FUTURE BOND PROCEEDS TO THE FY25 BUDGET.
THERE IS ALSO A SEPARATE REIMBURSEMENT RESOLUTION THAT WE ARE REQUESTING.
ANYTIME THAT WE MAKE PURCHASES AND ISSUE DEBT IN THE FUTURE, WE MUST HAVE THE BOARD APPROVE A REIMBURSEMENT RESOLUTION.
WE ARE REQUESTING TWO SEPARATE RESOLUTION APPROVALS THIS EVENING.

FUND BALANCE AND APPROPRIATION OF THAT AMOUNT TO CLOSE THAT GAP BETWEEN THE SEVEN MILLION DOLLAR REQUEST AND THE AMOUNT AVAILABLE THROUGH THE ISSUANCE OF DEBT, WHICH WAS ADDRESSED IN YOUR LAST PUBLIC HEARING.THE DIFFERENCE BETWEEN THOSE TWO AMOUNTS IS 3,829,000 AND THE RECOMMENDED FUNDING SOURCE IS OUR GENERAL FUND, FUND BALANCE.
THIS IS JUST A RECAP AGAIN OF THE REQUEST MADE BY INTERIM CHIEF TAYLOR, TOTALING SEVEN MILLION DOLLARS, WHICH DID INCLUDE A CONTINGENCY AS THE PRICE OF THESE APPARATUS RAPIDLY CHANGES.
IF APPROVED, THE UNRESERVED GENERAL FUND, FUND BALANCE APPROPRIATION OF UP TO 3,829,000 WOULD RESULT IN A TRANSFER FROM THE GENERAL FUND TO THE CAPITAL IMPROVEMENT FUND FOR FY '25.
THIS IS A MULTI YEAR FUND, WHOSE APPROPRIATION DOES NOT LAPSE ON JUNE 30TH, SO IT WOULD ALLOW FOR FUTURE STAGGERED PURCHASES.
THE LANGUAGE IN THE ADVERTISEMENT AND RESOLUTION DOES SAY UP TO 3,829,000 SO IF THE BOARD SO CHOSE, THEY COULD APPROVE AN APPROPRIATION FOR LESS THAN THAT AMOUNT, BUT NOT MORE FOLLOWING THE PUBLIC HEARING.
AGAIN, WE ARE REQUIRED TO HOLD A PUBLIC HEARING WHEN WE HAVE A BUDGET AMENDMENT THAT EXCEEDS 1.6 MILLION, SO THAT ADVERTISEMENT DOES HAVE TO APPEAR IN A PAPER ONE TIME AT LEAST SEVEN DAYS PRIOR TO THE PUBLIC HEARING.
THE AD DID APPEAR IN THE OCTOBER 1ST EDITION OF THE PROGRESS INDEX, AND AGAIN, IT DID MENTION OF THE FUNDING SOURCE, THE AMOUNT OF THE BUDGET AMENDMENT, AND I INCLUDED LANGUAGE TO STATE THAT IT WOULD NOT NECESSITATE ANY TAX INCREASE AS IT IS USING CASH RESERVES.
IT ALSO WOULD NOT BRING OUR FUND BALANCE LEVEL BELOW OUR POLICY GUIDELINES, WHICH IS 12.5% OF EXPENDITURES.
THE IMPACT AGAIN, NO TAX INCREASE.
WE ARE WITHIN OUR POLICY GUIDELINES OF MAINTAINING FUND BALANCE AND THE UN AUDITED PRELIMINARY NUMBER, WE ARE INCREASING OUR FUND BALANCE BY ABOUT 9.5 MILLION.
THIS APPROPRIATION WHEN COMBINED, WITH THE DEBT ISSUANCE DOES BRING US TO ABOUT 29.1% OF OUR BUDGETED EXPENDITURES.

MR. STOKE. AS MS.DREWRY MENTIONED, I HAVE PREPARED SOME LANGUAGE TO ALLOW FOR THE FLEXIBILITY THAT IN THE EVENT THAT THERE'S A VERY TIGHT TURNAROUND IN TERMS OF EQUIPMENT BECOMING AVAILABLE AND OUR NEED TO ORDER IT.
THAT THE COUNTY ADMINISTRATOR IN SUCH A CIRCUMSTANCE WOULD BE AUTHORIZED TO PLACE THAT ORDER.
THE POLICY FOR OVER $50,000 GENERALLY REQUIRES THAT THOSE PURCHASES COME TO THE BOARD.
BUT THE PURPOSE OF THIS IS TO NOT ONLY GIVE US THE MONEY TO BUY SOMETHING, BUT ALSO THE MONEY TO BUY SOMETHING WHEN IT BECOMES AVAILABLE UNDER A SHORT TIME LINE.
I WOULD REQUEST THAT YOU APPROVE THIS ADDED LANGUAGE TO THE POLICY, AND I WILL ALSO PROVIDE THAT THE ULTIMATE CONTROL IS STILL WITH THE BOARD BECAUSE THE LANGUAGE IN THE POLICY STATES THAT IT IS CONTROLLED BY THE BUDGET AND THE AMOUNTS THAT ARE APPROPRIATED.
EVEN IF YOU HAD MORE MONEY IN YOUR BUDGET, BUT ONLY WANTED TO APPROPRIATE A LESSER AMOUNT, THE COUNTY ADMINISTRATOR WOULD BE LIMITED BY THAT APPROPRIATION AND WOULD ALSO HAVE TO SHOW THAT IT'S A CIRCUMSTANCE WHERE THERE'S A SHORT WINDOW AVAILABILITY.
