AS I MENTIONED, THE BUILDING WAS FORMERLY OPERATED AS A COMMERCIAL CHILDCARE CENTER THAT WAS UNDER A SPECIAL EXCEPTION IN 1991.
THE PROPOSED USE OF THE DAY SUPPORT SERVICES IS GENERALLY CONSISTENT WITH THE COMPREHENSIVE PLAN, WHICH CALLS FOR BUSINESS USE AND AS WELL AS THE SURROUNDING ZONING AND CURRENT LAND USES ARE CONSISTENT WITH THIS.
THE ACTIONS REQUIRED BEFORE THE OPERATIONS BEGIN, THE APPLICANT WOULD NEED TO OBTAIN AN UPDATED CERTIFICATE OF OCCUPANCY THAT WOULD CONFIRM THAT THE BUILDING MEETS ALL APPLICABLE BUILDING CODES FOR THAT TYPE OF USE INSIDE OF THE BUILDING, AND THEY NEED TO OBTAIN A COUNTY BUSINESS LICENSE.
IT'S NOTABLE THAT THE EXISTING ENTRANCES, THERE'S TWO COMMERCIAL ENTRANCES THAT WOULD SUPPORT THE EXPECTED TRAFFIC GENERATION, WHICH IS NOT EXPECTED TO BE A SIGNIFICANT AMOUNT.
PUBLIC COMMENTS, WE DIDN'T RECEIVE ANY PUBLIC COMMENTS, WE DID ADVERTISE THIS IN ACCORDANCE WITH THE STATE CODE, AND WE ALSO PLACED THE SIGN ON THE PROPERTY.
STAFF RECOMMENDS APPROVAL, SUBJECT TO THE RECOMMENDED CONDITIONS AND THOSE CONDITIONS INCLUDE SPECIFYING THAT THIS IS FOR A DAY SUPPORT SERVICES FACILITY AND PROVIDING A DEFINITION FOR WHAT THAT MEANS.
WOULDN'T BE ALLOWED OTHER TYPES OF SPECIAL CARE HOSPITALS, THIS IS SPECIFICALLY FOR WHAT WAS OUTLINED IN THE APPLICATION AND FOR DEVELOPMENTAL AND INTELLECTUAL DISABILITIES SUPPORT AND THE PEOPLE WOULD NOT RESIDE THERE.
THEY'RE JUST CARED FOR DURING THE DAY.

THE GOALS OF THE APPLICANT ARE TO FIRST AND FOREMOST, COMPLETE A BOUNDARY LINE ADJUSTMENT AS PART OF THEIR PURCHASE OF LAND.
THAT BOUNDARY LINE ADJUSTMENT CAN'T CURRENTLY BE APPROVED BECAUSE ONE OF THE PARCELS OR ACTUALLY THE RESULTING PARCEL WOULD NOT BE FIVE ACRES, AND PART OF IT IS ZONED IN A WAY THAT REQUIRES FIVE ACRES.
SO ZONING IT TO BE ONE WOULD ALLOW THE LOT TO COMPLY, AND THEN ALSO VERY IMPORTANT WOULD ALLOW THEM TO DEVELOP IT FOR THE COMMERCIAL USES THAT THEY HAVE PLANNED FOR THE FUTURE.
SO AGAIN, THAT'S THEIR GOAL IS BUY THE PLANS AND THEN DEVELOP IT FOR COMMERCIAL USE IN THE FUTURE.
PART OF THIS IS APPLYING NEW PROFFERS TO REPLACE THE OLD ONES SO THAT THERE'S ONE SET OF RULES FOR THAT WHOLE THREE ACRES AT THE END OF THIS WHOLE PROCESS.

SO THE APPLICANT'S REQUEST, AGAIN, IS TO REZONE.
THAT'S THEIR INTENT IS TO REZONE THREE ACRES, SUBJECT TO PROFFERS.
THE APPLICATION MATERIALS SAY 2.343, BUT WE'RE WORKING ON GETTING THE PAPERWORK CORRECTED, IT'S THREE ACRES.
SO THERE, OF COURSE, THE ACTION REQUIRED BY THE PLANNING COMMISSION IS TO REVIEW THIS AND RECOMMEND APPROVAL OR RECOMMEND DENIAL AND FORWARD THAT TO THE BOARD FOR THEM TO MAKE A DECISION.
WE WORKED WITH THE APPLICANT ON THOSE PROFFERS AND RECOMMEND ACCEPTANCE OF WHAT THEY PROVIDED.
THERE'S REALLY JUST TWO PROFFERS, ONE IS TO RESTRICT THE POSSIBLE USES OF THE PROPERTY ALONG THE LINES OF OFFICE RETAIL RESTAURANT TYPE USES AND LEAVING OUT LESS DESIRABLE BUSINESS TYPE LAND USES.
THEY ALSO PROMISED TO PROVIDE A 15 FOOT LANDSCAPED BUFFER IN BETWEEN THE B1 ZONED LAND THAT THEY WILL OWN AT THE END OF THIS AND IN BETWEEN THAT AND ANY ADJACENT RESIDENTIAL OWNED PROPERTY.
SO IF THE ALLIN FARM, FOR EXAMPLE, IS DEVELOPED WITH RESIDENTIAL, IF THAT'S HOW THAT GOES THEN THERE WOULD BE A BUFFER IN BETWEEN THIS PROPERTY AND THAT PROPERTY.
SO IF THIS IS APPROVED AND THE PROPERTY IS REZONED, THEN IT COULD BE DEVELOPED WITH ANY OF THE LISTED LAND USES AS OUTLINED IN THE PROFFER STATEMENT, AND THAT'S A MORE LIMITED LIST THAN IS ALLOWED BY RIGHT IN THE B1 ZONING.
