WE HAVE THIS WAIVER REQUEST, SW23-04, AND IT IS A REQUEST TO WAIVE STANDARDS CONTAINED IN ARTICLE SEVEN OF THE SUBDIVISION ORDINANCE. AS IS AUTHORIZED IN ANOTHER SECTION OF THE ORDINANCE.

AND THAT IS TO PERMIT A SUBDIVISION OF ONE LOT INTO TWO FOR A FAMILY SUBDIVISION WITHOUT ADHERING TO ALL OF THE DESIGN STANDARDS OF ARTICLE SEVEN. SO SPECIFICALLY, THEY WANT TO REQUEST A WAIVER OF A CERTAIN CODE SECTION, WHICH REQUIRES THAT PRIVATE ROADS SHALL MEET MINIMUM DESIGN STANDARDS, AS GIVEN IN THE LATEST EDITION OF THE VDOT SUBDIVISION STREET DESIGN GUIDE.

SUBJECT PROPERTY IS ZONED RA.

IT'S LOCATED ON AN EXISTING PRIVATE ROAD SHARED BY TWO LOTS THAT ACCESSES SHANDS ROAD.

AND THIS IS APPROXIMATELY 1400FT SOUTH OF THE INTERSECTION WITH SPAIN DRIVE.

AND IT HAS A TAX MAP NUMBER PROVIDED TO IDENTIFY THE PROPERTY.

AND THERE IS A SUBDIVISION PLAT THAT GOES ALONG THAT OR THAT CORRESPONDS WITH THIS REQUEST.

THAT'S ON FILE IN THE PLANNING DEPARTMENT.

THIS IS A MAP OF THE LOCATION OF THE PROPERTY OFF AGAIN OFF OF SHANDS ROAD.

AND IT'S OUTLINED IN RED HERE.

AND IT'S IN THE SOUTHERN PART OF THE COUNTY JUST WEST OF INTERSTATE 95.

THE PROPERTIES OUTLINED IN BLUE HERE, AND THE PROPERTY IN BLUE IS PROPOSED TO BE SUBDIVIDED SUCH THAT THE PROPERTY OR THE OUTLINE IN BLACK WOULD BE A NEWLY CREATED LOT.

AND THE PURPOSE OF THE NEWLY CREATED LOT IS FOR A FAMILY MEMBER.

THE APPLICANT'S DAUGHTER AND HER FAMILY TO HAVE A HOUSE TO LIVE IN VERY CLOSE BY.

SO YOU HAVE AN ILLUSTRATION OF THE SHARE, THE ROAD DRIVEWAY ENTRANCE, WHICH IS IN PURPLE.

IT COMES OFF OF SHANDS ROAD, ENTERS, CROSSES ONE PERSON'S PROPERTY AND ENTERS INTO THE THIS PROPERTY.

AND THEN YOU CAN SEE WHERE IF THIS LOT IS DIVIDED AS PLANNED, THEN THERE WOULD BE A PRIVATE DRIVEWAY GOING TO THE EXISTING HOUSE WHICH IS ALREADY THERE, EXISTING DRIVEWAY, AND THEN A NEW LITTLE DRIVEWAY GOING TO THE NEW LOT.

STACIA LEE. THEY SUBMITTED A PLAT TO SUBDIVIDE THE PROPERTY AS I WAS DISCUSSING.

AND SINCE THE SUBDIVISION ORDINANCE REQUIRES CERTAIN STANDARDS AND VARIOUS REQUIREMENTS.

AND THOSE ARE WHAT WE REVIEW WHEN WE REVIEW THESE PLOTS.

AND WITHIN THAT WHOLE SUBDIVISION ORDINANCE, THERE'S A SPECIFIC CODE SECTION THAT REQUIRES THAT IN ORDER FOR THAT TO BE DIVIDED, THAT THE ROAD HAS TO MEET A VDOT STANDARD, EXCEPT IT CAN BE GRAVEL.

AND THAT BASICALLY MEANS THAT IT WOULD NEED FOR THIS TO GET APPROVED.

THEY WOULD HAVE TO WIDEN THAT ROAD IN TERMS OF GRAVEL, MAYBE HAVE DITCHING.

THERE'S THINGS LIKE THAT THEY WOULD HAVE TO DO TO INCREASE THE LEVEL OF, YOU KNOW STANDARD OF THAT ROAD TO A HIGHER LEVEL.

AND SO THEY HAVE STATED THAT THE COST ASSOCIATED WITH THAT REQUIREMENT WOULD POSE A SUBSTANTIAL INJUSTICE OR HARDSHIP, AND ESPECIALLY TAKING INTO CONSIDERATION THAT THIS IS FOR A FAMILY MEMBER TO BUILD A HOME.

AND SO AND AGAIN, I THINK THEY ALL LIVE IN THE HOUSE THAT'S ON THE PROPERTY NOW.

THE APPLICANT WILL COME UP AND AND SHARE MORE AFTER ME, I'M SURE.

SO ARTICLE THERE'S ANOTHER PART OF THE SUBDIVISION ORDINANCE THAT ENABLES PEOPLE TO ASK FOR WAIVERS OF CERTAIN REQUIREMENTS WHEN THEY POSE A SUBSTANTIAL INJUSTICE OR HARDSHIP OR IN UNUSUAL SITUATIONS.

SO AGAIN, THEY JUST WANT TO DIVIDE AND CONVEY A LOT TO THEIR DAUGHTER, AND THEY REQUEST A WAIVE A CERTAIN REQUIREMENT OF WHICH IS ABOUT ROAD CONSTRUCTION STANDARD. AND THEY PROVIDED JUSTIFICATION IN THEIR APPLICATION MATERIALS.

AND I'VE COVERED MOST OF THAT, YOU KNOW, SOME ADDITIONAL DETAILS ARE THAT THEY HAVE A ROAD MAINTENANCE AGREEMENT WITH THE ONE OTHER PROPERTY OWNER THAT USES THAT ROAD ENTRANCE.

AND. YEAH.

AND THEY AGAIN, THEY THINK THIS IS A SUBSTANTIAL INJUSTICE OR HARDSHIP.

AND THAT'S WHY THEY'VE ASKED FOR A WAIVER.

SO THE ACTIONS FOR THE PLANNING COMMISSION ARE TO APPROVE OR DENY THE REQUEST AND EITHER WAY PROVIDE A REASON FOR YOUR DECISION.

OR PROVIDE REASONS FOR YOUR DECISION.

AND THEN YOU ALSO NEED TO DECIDE IF YOU'RE GOING TO INCLUDE CONDITIONS ON THE APPROVAL OR NOT.

AND STAFF HAS RECOMMENDED SOME CONDITIONS, AND WE'LL GET TO THOSE IN A MINUTE.

PLANNING DEPARTMENT COMMENTS.

THE PLAT IS ESSENTIALLY READY TO APPROVE IT, EXCEPT FOR THIS DETAIL THAT WE ARE FOCUSED ON TONIGHT.

SINCE THE WAIVERS WERE FIRST AUTHORIZED, THERE HAVE BEEN PRIOR WAIVERS PRIOR TO TONIGHT, INCLUDING IN LAST YEAR, THERE WAS ONE THAT WAS SIMILAR TO THIS FOR ANOTHER PRIVATE ROAD WHERE A COST WAS CITED AS A SUBSTANTIAL INJUSTICE OR HARDSHIP.

SO STAFF HAS REVIEWED THIS AGAINST THE CRITERIA THAT'S PROVIDED IN THE ORDINANCE.

AND SO WE'RE SUMMARIZING HERE FOR YOU THAT WHAT WE FOUND FROM THE CRITERIA.

FIRST OF ALL, IN DETERMINING WHETHER THIS IS AN UNUSUAL SITUATION OR WHETHER IT'S STRICT ADHERENCE WOULD POSE A SUBSTANTIAL INJUSTICE OR HARDSHIP.

STAFF DOESN'T THINK IT'S UNUSUAL SITUATION BECAUSE THE SAME REQUIREMENT APPLIES TO ANYONE ELSE.

BUT THE PLANNING COMMISSION, YOU KNOW, CAN MAY DECIDE THAT THIS IS A SUBSTANTIAL INJUSTICE OR HARDSHIP.

SO IF YOU THINK THAT IT IS, THEN THAT WOULD BE A REASON TO TO CONSIDER APPROVING IT.

OF THE OTHER CRITERIA, YOU ALSO HAVE TO MAKE SURE IT'S NOT ILLEGAL.

STAFF DOESN'T THINK THERE'S ANYTHING ILLEGAL ABOUT THIS, AND YOU NEED TO MAKE SURE THAT IT DOES NOT PREJUDICE THE HEALTH, SAFETY CITIZENS OF OTHER CITIZENS OF THE COUNTY.

AND STAFF DOESN'T THINK THAT'S AN ISSUE EITHER.

SO IT REALLY FALLS IN OUR OPINION, IT FALLS ON WHETHER YOU THINK THERE'S A SUBSTANTIAL INJUSTICE OR HARDSHIP.

THERE WERE NO PUBLIC COMMENTS.

WE DID NOTIFY ALL ADJACENT PROPERTY OWNERS BY MAILING.

AND SO STAFF'S RECOMMENDATION AGAIN, THIS IS A WAIVER REQUEST.

AND YOU HAVE CRITERIA IN THE ORDINANCE FOR THE PLANNING COMMISSION TO MAKE A DECISION.

SO WE DON'T HAVE A PARTICULAR RECOMMENDATION, BUT WE HAVE PROVIDED THAT CRITERIA FOR YOUR CONSIDERATION.

AND AGAIN, IF YOU APPROVE IT, THEN YOU NEED TO FIND THAT IT MEETS ALL OF THE CRITERIA THAT ARE PROVIDED.

WE'VE JUST GONE OVER THOSE.

SO WE HAVE SAMPLE MOTIONS FOR YOU IN YOUR PACKET TO HELP WITH WORK THROUGH THOSE FINDINGS THAT WHICHEVER WAY YOU GO ON THIS DECISION AND THERE IS A DRAFT RESOLUTION IF YOU CHOOSE TO APPROVE IT, AND A DRAFT RESOLUTION IF YOU CHOOSE TO DENY IT.

FINALLY, THE RECOMMENDED CONDITIONS ARE VERY BRIEF.

NUMBER ONE, WE WOULD RECOMMEND THAT IF THIS IS APPROVED, THAT THERE BE CONDITIONS SAYING THAT IT'S JUST FOR ONE ADDITIONAL LOT.

IT'S NOT OPEN ENDED.

TO JUST KEEP DIVIDING THE PROPERTY IS JUST ONE ADDITIONAL LOT.

THE JUST A STANDARD COMMENT THAT IT IS NOT TO BE IMPROVED WITH ANY STATE OR LOCAL FUNDS. THERE ARE NO FUNDS FOR THIS.

BUT UNLESS OTHERWISE PROVIDED FOR LAW IN THE FUTURE.

AND THEN MAINTENANCE OF THE PRIVATE ROAD SHALL BE GOVERNED BY A RECORDED ROAD MAINTENANCE AGREEMENT.

AND THE APPLICANTS HAVE ALREADY RESOLVED THAT BY RECORDING A ROAD MAINTENANCE AGREEMENT.

SO, AGAIN, THEY HAVE AN AGREEMENT WITH THE ONE OTHER USER OF THE ROAD.

SO THAT PART IS RESOLVED AND THEN THE FINAL CONDITION IS JUST SAYING THAT THE PLOT HAS TO MEET ALL OTHER APPLICABLE REQUIREMENTS, AND THEY'LL NEED TO HAVE A NOTE ON THE PLOT IF THIS WAIVER IS APPROVED.

SO THE NOTE WOULD SAY THAT THERE WAS A SPECIAL WAIVER FOR THIS REQUEST.

SO THAT CONCLUDES STAFF'S COMMENTS.

WHO HAVE OWNED THE 42 ACRE PARENT [INAUDIBLE] SET 2000 AND HAVE LIVED ON THE PROPERTY FOR OVER 20 YEARS.

THEY RAISED THEIR DAUGHTER, TRINITY WHO THEY PROPOSED TO CONVEY A FIVE ACRE PARCEL SHOWN ON THE PLAT.

AND TRINITY IS HERE.

AND SHE'S MARRIED.

HER HUSBAND IS WORKING.

TRINITY WORKS AT SOUTH ELEMENTARY SCHOOL.

AND THEY HAVE TWO CHILDREN, AND.

ALL OF THEM ARE LIVING WITH THE APPLICANTS AND IN THEIR HOME ON THE 42 ACRE PARCEL.

THE UNIMPROVED ROAD FROM SHANDS ROAD TO THE 42 ACRE PARCEL HAS BEEN THE SAME ACCESS TO THE PROPERTY AND HAS BEEN USED BY THE APPLICANTS TO GAIN ACCESS TO THEIR HOME ON THE LARGE TRACT SINCE THEY PURCHASED IT IN AROUND 2000.

THE APPLICANT, MR. TIMOTHY LEE, WAS A PIPEFITTER AND RETIRED WHEN HE BECAME DISABLED IN 2020, LATE 2021.

MRS. LEE IS ALWAYS BEEN IN THE HOME AND HOMESCHOOLED HER DAUGHTER TRINITY. I'M SORRY, MR AND MRS. LEE. NOW, [INAUDIBLE] TRINITY'S TWO CHILDREN.

WHILE SHE AND HER HUSBAND WORK OUTSIDE THE HOME.

AND WILL CONTINUE TO DO SO.

MR. AND MISS LEE HAVE TWO OTHER CHILDREN WHO CURRENTLY LIVE IN THE HOME.

THEY WANT TO PROVIDE A FIVE ACRE LOT TO THEIR DAUGHTER, TRINITY, AND A FAMILY NEARBY, AS THEY WILL CONTINUE TO TAKE CARE OF HER CHILDREN IN THEIR HOME.

NO MORE.

IF YOU ALL GRANT THIS REQUEST, AND THE FIVE ACRE PARCEL IS CONVEYED TO TRINITY AND THEY BUILD A HOME, NO MORE PEOPLE WILL BE USING THE EXISTING ROAD THAT ARE NOW USING IT.

MR. LEE IS UPGRADED THE ROAD OVER THE YEARS AND HAS WORKED VERY WELL.

THERE'S A ROAD MAINTENANCE AGREEMENT IN PLACE, AS MR. GRAVES POINTED OUT.

A COPY OF WHICH YOU HAVE IN YOUR PACKET.

I THINK IT'S PAGES 19 THROUGH 21, WHICH WILL MAKE THE APPLICANTS AND THEIR SIGNS AND THE ADJACENT LANDOWNERS ON SHANDS ROAD, WHO'S PROPERTY THE ACCESS EASEMENT CROSSES RESPONSIBLE FOR MAINTENANCE AND KEEPING THE EASEMENT OPEN AND PASSABLE AT ALL TIMES.

APPLICANTS REQUEST A WAIVER OF THE REQUIREMENT THAT THE PRIVATE ROAD FROM SHANDS ROAD TO THE PROPOSED SUBDIVISION LOT MEET THE DESIGN STANDARDS SET FORTH IN THE VDOT SUBDIVISION STREET DESIGN GUIDE.

THE REQUIRED HINDRANCE TO THE VDOT SUBDIVISION STREET DESIGN GUIDE WOULD BE.

COST PROHIBITED.

THIS ROAD IS A QUARTER OF A MILE OFF OF SHANDS ROAD.

AND HAS BEEN THE ACCESS TO THIS PROPERTY FOR LONG BEFORE THE LEES PURCHASED THIS LAND IN 2000.

THEY RESULT, IF THIS IS DENIED, WOULD PREVENT THE APPLICANTS FROM GIVING THEIR DAUGHTER FIVE ACRES OF THEIR 42 ACRES TO PROVIDE A HOME FOR THEM AND HER HUSBAND, WHO ARE CARED FOR ON A DAILY BASIS BY THE [INAUDIBLE].

IT WOULD IMPOSE A HARDSHIP ON BOTH FAMILIES TO REQUIRE THE DAUGHTER OF APPLICANTS TO FIND ANOTHER RESIDENTIAL BUILDING SITE, A BUILDING LOT IN SOME OTHER LOCATION OFF THE 42 ACRE PARCEL.

YOU COULD IMAGINE THAT THIS IS A CLOSE KNIT FAMILY.

IF ALL OF THEM ARE LIVING TOGETHER AT THE PRESENT TIME.

FOR THESE REASONS, WE SUBMIT THAT THIS IS AN UNUSUAL SITUATION WHERE STRICT ADHERENCE TO THE GENERAL REGULATION IN THIS ORDINANCE WOULD RESULT IN SUBSTANTIAL INJUSTICE OR HARDSHIP.

AND WE ASK THAT YOU APPROVE THIS SUBDIVISION WAIVER REQUEST.
