ALL RIGHT. AND THIS IS A REQUEST TO PERMIT A COMMERCIAL CHILD CARE CENTER WITHIN A BUSINESS ZONING DISTRICT PURSUANT TO THE ZONING ORDINANCE.

THE SUBJECT PROPERTY IS APPROXIMATELY 0.66 ACRES IN SIZE.

IT'S LOCATED AT 5.842 ALLEN ROAD AND IS IDENTIFIED AS TAX MAP NUMBER THAT'S PROVIDED THERE.

THE COMPREHENSIVE PLAN INDICATES THIS PROPERTY IS PLANNED FOR VILLAGE CENTER USES.

UH, THIS SLIDE SHOWS THE LOCATION MAP.

YOU CAN SEE THE PROPERTY OUTLINED IN RED.

IT'S ONE OF THREE PARCELS THAT MAKE UP A THREE UNIT OR THREE BUILDING, UH, OFFICE COMPLEX ON COURTHOUSE ROAD NEAR THE ROUNDABOUT OR TRAFFIC CIRCLE WITH ALLEN ROAD.

THERE'S THE AERIAL VIEW, AND YOU CAN SEE IT'S THE BUILDING IN THE MIDDLE OF THOSE THREE.

AND EACH OF THOSE IS ON THEIR OWN SEPARATELY OWNED PROPERTY.

AND THIS IS THE ZONING MAP.

THE PROPERTY IS ZONED GENERAL BUSINESS.

IT'S AGAIN IN THE MIDDLE OF TWO OTHER BUILDINGS OR PROPERTIES.

AND YOU CAN SEE ON EITHER SIDE OF THE ROAD THERE'S BUSINESS ZONING DISTRICT.

AND TO THE REAR OF THAT PROPERTY.

AGAIN, THE REQUEST IS OR THE GOAL IS TO OPEN A CHILD CARE CENTER IN THAT BUILDING.

AND SO THE LAND USE AND THE ZONING ORDINANCE IS CALLED A COMMERCIAL CHILD CARE CENTER.

DEFINITION IS PROVIDED THERE.

ESSENTIALLY, IT IS PROVIDING CARE PROTECTION AND GUIDANCE TO CHILDREN SEPARATED FROM THEIR PARENTS OR GUARDIAN DURING ANY PART OF THE DAY.

AND SO THE ACTION REQUIRED BY THE PLANNING COMMISSION IS TO RECOMMEND APPROVAL OR RECOMMEND DENIAL, AND THEN FORWARD THIS TO THE BOARD FOR A DECISION.

STAFF COMMENTS.

SUMMARY. THE PROPOSED USE IS GENERALLY CONSISTENT WITH THE COMPREHENSIVE PLAN FOR THIS AREA AND THE SURROUNDING ZONING AND LAND USES.

THE ACTIONS REQUIRED BEFORE THE OPERATIONS CAN CAN BEGIN, SO IF THIS IS APPROVED, THE APPLICANT WOULD HAVE TO OBTAIN AN UPDATED CERTIFICATE OF OCCUPANCY SHOWING THAT THE BUILDING MEETS ALL THE REQUIREMENTS TO HAVE A CHILD CARE CENTER IN IT.

THEY'D HAVE TO OBTAIN A STATE LICENSE FOR CHILD CARE CENTER, AND THEY'RE ALREADY WORKING ON THAT.

UM, AND THEY WOULD NEED TO OBTAIN A COUNTY BUSINESS LICENSE, WHICH INCLUDES A FINAL STEP OF ZONING APPROVAL, MAKING SURE THIS THE OTHER THINGS ARE DONE.

THERE WERE NO OTHER STAFF COMMENTS REALLY REQUIRING ANY ACTION OR ANYTHING.

UM, PUBLIC COMMENTS, THERE WERE NOT ANY.

WE DID ADVERTISE THIS IN ACCORDANCE WITH THE STATE CODE, BUT WE HAVEN'T HEARD ANYTHING FROM THE PUBLIC ON THIS.

UM, AND STAFF'S RECOMMENDATION IS APPROVAL OF THIS CHILD CARE CENTER AT THIS LOCATION, SUBJECT TO ONLY FOUR CONDITIONS.

UM, THAT ARE THE EXACT WORDING IS IN THE STAFF REPORT, BUT BASICALLY THE FIRST TWO ARE SPECIFYING THAT THIS IS A CHILD CARE CENTER PERMITTED AS DEFINED. AND ALL REQUIRED LICENSES AND PERMITS FROM THE STATE AND LOCAL GOVERNMENT MUST BE OBTAINED.

AND THEN THE OTHER TWO CONDITIONS ARE STANDARD CONDITIONS THAT IF THE IF IT'S IN, IT'S ABANDONED FOR 24 MONTHS AND IT WOULD BE NULL AND VOID.

UM, AND SOMEONE WOULD HAVE TO COME BACK FOR A NEW APPROVAL OF THIS USE, SINCE IT IS A SPECIAL EXCEPTION.

USE. UM, AND OF COURSE, IF THEY DON'T FOLLOW THE LAWS, THE PERMIT CAN BE REVOKED.

UH, WHICH THE APPLICANT HAS REQUESTED TO RESERVE APPROXIMATELY 2.2 ACRE PROPERTY FROM GENERAL AGRICULTURAL DISTRICT A-1. UH, TO ELIMINATE RESIDENTIAL DISTRICT R-1.

UH, WITH NO PROPER CONDITIONS, THIS WOULD ALLOW FOR THEM TO TAKE THE SOUTHERN BOUNDARY LINE TO BE REPOSITIONED, SO THAT THE EXISTING GARAGE WILL BE LOCATED ON THE SOUTHERN PARCEL.

UH, WITH THE EXISTING DWELLING.

UH, RIGHT HERE YOU HAVE AN AERIAL VIEW OF THE PROPERTY CURRENTLY VACANT.

AND TO THE SOUTH OF IT IS WHERE THE HOUSE WOULD BE FOR FOR THE GARAGE AND WELL.

HERE SINCE EARLY MAPS SHOWING THAT THAT PARCEL IS A1 AND ALL AROUND IT, IT'S THE R1 PROPERTIES.

UH, FUTURE LAND USE MAP FROM THE COMP PLAN SHOWS THE RESIDENTIAL.

UH, THIS IS A PLAT THAT'S UNDER A REVIEW AT OUR OFFICE.

AS YOU CAN SEE, THE LINE THERE FROM THE SOUTHERN PROPERTY TO BE VACATED AND MOVE, MOVE TO THE NORTH.

UM, A LITTLE BACKGROUND ON PROPERTIES.

IN 1982, LOIS HARRISON DID A FORMAL REZONING APPLICATION, AND IT WAS APPROVED FOR, UH, THE PROPERTY FROM R1 TO A1 SO THAT A MOBILE HOME CAN BE PLACED ON THE PROPERTY.

UH, THE APPLICANT'S GOALS IS TO ADJUST THAT BOUNDARY LINE.

UH, AND SO THAT ALSO, UM, FINALIZED THE SALE OF THE PROPERTY.

THE ACTION REQUIRED BY THE PLANNING COMMISSION WOULD BE TO RECOMMEND APPROVAL OR DENIAL, AND FORWARD TO THE BOARD OF SUPERVISORS FOR A DECISION.

UH, STAFF. THIS REZONING IS CONSISTENT WITH THE SURROUNDING ZONING, DISTRICTS, AND SURROUNDING USES.

UH STAFF ALSO FINDS THAT REZONING IS CONSISTENT WITH THE FUTURE LAND USE MAP DESIGNATION OF RESIDENTIAL.

THE COMP PLAN. UM, THE REASON THAT THEY'RE DOING THE BOUNDARY LOT ADJUSTMENT AND IT CAN'T BE DONE BY RIGHT, IS BECAUSE OF THE FIVE FIVE ACRE MINIMUM IN THE A1 DISTRICT.

UH, NO MAJOR IMPACTS ON TRAFFIC OR SCHOOLS ARE ANTICIPATED BECAUSE OF THE REZONING, AND THE APPLICANT MUST ADHERE TO THE R1 ZONING AND SUBDIVISION REGULATIONS REGARDING ANY POTENTIAL FUTURE SUBDIVISIONS.

UH, ALSO, NO PROFFERS WERE PROPOSED BY THE APPLICANT.

UH, THE CASE WAS ADVERTISED IN ACCORDANCE WITH STATE CODE.
