TONIGHT I WILL BE PRESENTING SPECIAL EXCEPTION SC BZA-23-01.

THE REQUEST IS MADE BY THE APPLICANT, WHICH IS WHO IS MICHAEL D DANKENBRING, AND HE'S REQUESTING A SPECIAL EXCEPTION PURSUANT TO SECTION 90-203.1 OF THE PRINCE GEORGE COUNTY ZONING ORDINANCE TO ALLOW A PRIVATE ANIMAL BOARDING PLACE.

IN A R1 GENERAL RESIDENTIAL ZONING DISTRICT.

A PRIVATE ANIMAL BOARDING PLACE MEANS A PLACE WHERE FOUR OR MORE DOGS MORE THAN FOUR MONTHS OLD, ARE KEPT FOR PRIVATE USE.

THE APPLICANT IS REQUESTING TO KEEP FIVE DOGS ON THE PROPERTY.

A SPECIAL EXCEPTION IS REQUIRED FOR THE USE IF THE DOGS ARE KEPT ON A RESIDENTIALLY USED PARCEL THAT IS LESS THAN ONE ACRE IN SIZE.

THE SUBJECT PROPERTY IDENTIFIED AS TAX MAP 05A-05002-0 IS LOCATED AT 11005 IRONWOOD DRIVE AND IS APPROXIMATELY 0.39 ACRES IN SIZE IN ZONE R1 LIMITED RESIDENTIAL.

THE COMPREHENSIVE PLAN INDICATES THAT THE PROPERTY IS SUITABLE FOR RESIDENTIAL USES.

IN YOUR PACKET YOU THERE IS THE LOCATION MAP SHOWING THE LOCATION OF THE LOT THAT'S IN QUESTION.

BACKGROUND. IN 2012, PRINCE GEORGE'S COUNTY AMENDED THE COUNTY CODE TO LIMIT THE NUMBER OF DOGS ALLOWED ON A RESIDENTIALLY USED PARCEL OF AN ACRE OF LESS OF AN ACRE OR LESS IN SIZE.

AND THEN A MINUTE, THE ZONING ORDINANCE TO ADD PRIVATE ANIMAL BOARDING PLACE AS A USE WHICH MAY BE ALLOWED BY SPECIAL EXEMPTION FROM THE BZA. ON MARCH 16TH, 2023, PLANNING AND ZONING STAFF RECEIVED AN APPLICATION FROM MICHAEL DANKENBRING FOR THE KEEPING OF FIVE DOGS ON HIS PROPERTY.

A SIMILAR REQUEST WAS HEARD AND APPROVED ON AUGUST 22ND, 2022.

WITH THAT CASE, THE APPLICANT CAME TO THE BZA AND REQUESTED TO KEEP FOUR DOGS ON A 0.49 ACRE LOT ZONED R1 LOCATED AT 2611 ROSEBUD COURT.

THE SUMMARY OF THE REQUEST.

THE APPLICANT WISHES TO KEEP FIVE DOGS AT HIS RESIDENCE.

THE DOG CONSISTS OF ONE SHITZU, NINE YEAR OLD MALE, ONE BASSET HOUND, A FOUR MONTH OLD FEMALE, TWO CANINE CANE CORSO MIX, A THREE YEAR OLD FEMALE AND A SIX YEAR OLD MALE AND ONE BULLY, ONE YEAR OLD AND FEMALE.

THE DOGS ARE PRIMARILY KEPT INDOORS.

THE REAR YARD IS FENCED IN ALL SIDES WITH A METAL GATED FENCE.

THE DOGS USE THE BACKGROUNDS FOR LIMITED TIMES DURING THE DAY OR EVENING.

IN YOUR PACKETS YOU SEE EVERY VIEW OF THE PROPERTY IN QUESTION.

ALSO, YOU SEE PHOTOS OF THE FENCE.

SOME BACK YARD IN THE PICTURE SHOWS THAT THE PROPERTY IS ADEQUATELY FENCED FROM THE ADJOINING PROPERTY OWNERS. STAFF.

VIEW COMMENTS.

SINGLE FAMILY DWELLINGS ABUT THE PROPERTY ON ALL SIDES.

THE LOT DIRECTLY ACROSS THE STREET IS VACANT.

EXPECTED IMPACTS ON ADJACENT PROPERTIES AND ROADWAYS WOULD BE.

NOISE AND ODOR ONLY IF THE DOGS ARE LEFT OUTSIDE FOR EXTENDED PERIODS OF TIME.

OPPORTUNITIES TO MITIGATE IMPACTS IS TO KEEP THE DOGS INSIDE PRIMARILY, WHICH THE APPLICANT DOES ALREADY.

AND A SITE VISIT WAS MADE TO THE PROPERTY ON APRIL THE 2ND, 2023 AND DURING THE SITE VISIT THE DOGS WERE INDOORS.

THERE WERE NO OUTDOOR PENS OR CAGES.

THE BACKYARD IS FENCED AND THERE APPEARS TO BE AMPLE SPACE FOR THE DOGS TO PLAY.

THE DOGS DID NOT BARK DURING THE VISIT.

NO, NO ODOR WAS NOTICEABLE DURING THE VISIT, AND THE OWNER STATED THAT THEY DISPOSED OF THE ANIMAL WASTE REGULARLY IN A TRASH RECEPTACLE THAT IS PICKED UP WEEKLY BY THE LOCAL TRASH COMPANY.

PUBLIC NOTICE AND COMMENTS.

ACCORDING TO THE CODE OF VIRGINIA, NOTICES WERE PROPERLY SENT TO THE ADJACENT PROPERTY OWNERS ON AUGUST 13TH AND A LEGAL AD RAN IN THE LOCAL PAPER FOR TWO CONSECUTIVE WEEKS.

THE AD RAN ON APRIL THE 11TH AND ON APRIL THE 18TH.

PUBLIC COMMENTS.

NO COMMENTS FROM THE PUBLIC HAS BEEN RECEIVED BY STAFF.

BZA CONSIDERATIONS.

TO EVALUATE THE REQUEST IN RELATION TO THE DEFINITION OF SPECIAL EXCEPTION, WHICH IS IF CONTROLLED AS TO THE NUMBER, AREA, LOCATION OR RELATION TO THE NEIGHBORHOOD, THE USE WOULD PROMOTE THE PUBLIC HEALTH, SAFETY, WELFARE, MORALS, ORDER, COMFORT, CONVENIENCE, APPEARANCE, PROSPERITY OF GENERAL WELFARE.

EVALUATE THE EXTENT TO WHICH THE PROPOSED LAND USE IS APPROPRIATE FOR THIS PARTICULAR PROPERTY LOCATION.

EVALUATE THE REQUEST IF IT WOULD BE APPROPRIATE TO CHANGE ANY OF THE RECOMMENDED CONDITIONS, SUCH AS ADDING ADDITIONAL CONDITIONS TO FURTHER REDUCE IMPACTS ON ADJACENT PROPERTIES.
