TONIGHT'S REQUEST THROUGH THE PROPERTY OWNER, MR. CHARLES SOKOLSKI AND THE APPLICANT MICHAEL ELLIS, IS FOR A ZONING SPECIAL EXCEPTION TO THE ZONING ORDINANCE TO CONTINUE AND EXPAND THE EXTRACTION OF RESOURCES.

IT'S THE BORROW PIT IN THE ARE A ZONING DISTRICT.

THIS FACILITY HAS BEEN IN USE IN THE PAST AND THEY ARE LOOKING TO IDENTIFY NEW AREAS ON THE FARM AREA AND EXPAND THE EXISTING PIT AREA.

THE COMP PLAN, LAND USE MAP, FUTURE LAND USE MAP DOES INDICATE THE PROPERTY IS RESIDENTIAL AND THAT IS WHY IT WOULD BE A SPECIAL EXCEPTION IN THIS DISTRICT.

THIS IS A LOCATION MAP.

THE PROPERTIES OWNED BY MR. SOKOLSKI ARE HIGHLIGHTED IN RED.

THERE ARE FOUR PROPERTIES THAT YOU CAN SEE.

THEY RUN FROM WEST QUAKER ROAD DOWN ALL THE WAY UP TO RALPH FOR 60 COUNTY DRIVE.

THIS IS THE ZONING MAP SHOWING THE RA DESIGNATION IN YELLOW AND THE SURROUNDING AREAS AS RAS AS WELL.

THIS IS THE AERIAL VIEW THAT SHOWS THE FARM AREA OF MR. SKOKIE, AS WELL AS SOME OF THE THE WETLANDS AND PONDS ON THERE.

JUST A BRIEF BACKGROUND IN CASE HISTORY.

THE SPECIAL EXCEPTION WAS FIRST GRANTED IN 1990 BY THE BOARD.

IT DID HAVE A REVIEW TIME PERIOD EXPIRATION DATE FOR EIGHT YEARS.

IT HAS BEEN RENEWED SEVERAL TIMES THROUGH THE YEARS.

THE BAR IS NOT HAS NOT BEEN UNDER SPECIAL EXCEPTION SINCE 2018 AND THEY ARE HERE WITH CO APPLICANT MR. ELLIS TO RENEW THE SPECIAL EXCEPTION AND EXPAND THEIR AREA TO IT TO A NEW AREA.

SO THE REQUEST IN SUMMARY IS TO CONTINUE AND EXPAND THE BAR OF PIP OPERATIONS.

THERE ARE THREE PARCELS THAT HAVE BEEN PERMITTED IN THE PAST AND A FOURTH PARCEL WOULD BE ADDED UNDER THIS APPLICATION.

THE PROPOSED DISTURB AREA CONSISTS OF APPROXIMATELY 23 ACRES IN THREE WORK AREAS.

OUT OF THE TOTAL OF, I BELIEVE IS 224 ACRES.

SO YOU'RE LOOKING AT APPROXIMATELY 10% OF THE FARM IS USED FOR THE BORROW PIT FUNCTION.

THEY ARE COVERED BY PERMITS FROM THE STATE FOR MINING AND THEY DO HAVE TO FOLLOW ALL OF THOSE REQUIREMENTS AND REGULATIONS AS WELL. THE PROPOSED HOURS OF OPERATIONS WILL BE MONDAY THROUGH SATURDAY FROM BASICALLY DAWN TO DUSK, WHICH EVEN IN THE SUMMER THEY WOULD BE 530.

THIS IS SIMILAR TO WHAT THEY'VE HAD IN THE PAST.

THEIR PRIMARY ACCESS ROAD IS LOCATED OFF OF WEST QUAKER ROAD.

THE APPLICANT IS LOOKING TO INSTALL A CONSTRUCTION ENTRANCE ONTO AN EXISTING PRIVATE ACCESS ROAD OFF OF FOUR 60 BECAUSE ONE OF THE AREAS IS RIGHT ADJACENT TO THAT ROAD.

WE HAVE LET HIM KNOW THAT HE WOULD HAVE TO GET PERMISSION TO USE THAT PRIVATE ROAD.

THIS IS THE LAYOUT OF THE THREE AREAS.

THE BOLD LINE IS, AGAIN, THE PROPERTY LINE OF THE FARM AREAS, THE FOUR PARCELS THAT MAKE UP THE TOTAL FARM AREA.

THE SMALLER DASHED AREAS THAT ARE LABELED A, B AND C AND C IS THE AREA THAT IS ADJACENT TO THE PRIVATE ROAD THAT THE APPLICANT MAY SEEK APPROVAL TO USE.

THIS IS A SUMMARY OF THE STAFF REVIEW COMMENTS THAT ARE IN YOUR PACKET AS WELL AND THAT WE DISCUSSED AT THE WORK SESSION ON MONDAY.

AND THE THE USE IS AGAIN THE STATE DEPARTMENT OF MINES, MINERALS AND ENERGY AND THEY'RE RESPONSIBLE FOR PERTAINING OBTAINING A SEPARATE PERMIT FOR THEM AND BEING IN COMPLIANCE WITH THAT.

THE REVIEW COMMENTS INCLUDE SOME EXPECTED IMPACTS.

IT WOULD BE THE TRUCK TRAFFIC AND NOISE ASSOCIATED WITH THE OPERATION.

I CAN SAY THAT IN THE PAST WE HAVE MINIMAL COMPLAINTS ABOUT TRUCK TRUCK TRAFFIC RELATED TO THIS SITE.

WE DO HAVE TRUCK COMPLAINTS ON WHAT'S QUAKER ROAD, BUT THOSE TEND TO COME FROM THE INDUSTRIAL PARK, NOT FROM THIS MINING OPERATION.

THE MITIGATION THAT THE APPLICANT HAS DONE IN THE PAST AND IS LOOKING TO DO THIS TIME ARE LISTED AS WELL, KEEPING THE EXISTING BUFFER OF TREES IN FOLLOWING THE COUNTY'S NOISE ORDINANCE AS WELL AS SOME THINGS IN THE RECOMMENDED CONDITIONS.

WE DO FEEL LIKE IT'S A COMPATIBLE WITH THE FUTURE LAND USE MAP, GIVING THE LOW VOLUME 10% USE ON THE 200 USES AND THE FACT THAT IT HAS BEEN IN EXISTENCE SINCE 1990 AND HAS SEEMED TO OPERATE IN HARMONY WITH THE SURROUNDING AREA. OTHER STAFF REVIEW COMMENTS ARE SUMMARIZED HERE FOR YOU AS WELL.

THEY ARE THE NORMAL COMMENTS FROM THE ENVIRONMENTAL AND VDOT.

THERE IS A COMMERCIAL ENTRANCE ALREADY IN PLACE BASED ON THE PREVIOUS APPROVALS FOR THIS FOR THIS USE.

AND AGAIN, IF THEY LOOK AT USING THE PRIVATE ROAD AT THE PETERSBURG JAIL ANNEX FACILITY IN FORM, THEY WOULD HAVE TO GET PERMISSION FROM THAT OWNER OF THE ROAD.

ON THE RECOMMENDED CONDITIONS, THE HIGHLIGHTS HERE.

WE'VE LOOKED AT THE CASE HISTORY AND THE HISTORY OF THE OPERATION, AND WE ARE ACTUALLY RECOMMENDING THAT A FIVE YEAR RENEWAL NOT BE INCLUDED THIS TIME.

HE HAS A LONG HISTORY OF SHOWING THAT THIS OPERATION CAN BE IN COMPLIANCE.

IT IS REGULATED BOTH BY THE LAW, BY LOCAL AND STATE REGULATIONS, AND WE ALWAYS HAVE THE CONDITION IN THAT IF THEY VARY OR DEVIATE FROM THEIR APPROVALS, THAT WE CAN REVOKE THE SPECIAL EXCEPTION.

SO AGAIN, THE STAFF RECOMMENDATION IS APPROVAL SUBJECT TO THE RECOMMENDED CONDITIONS CONTAINED IN YOUR IN YOUR PACKET AND IN THE DRAFT RESOLUTION.

WE WE LIKE TO PROVIDE THAT BECAUSE IT'S NOT A COMMON TERM NOWADAYS, BUT THE DEFINITION OF THAT TERM DOES INCLUDE THE RENTAL OF ROOMS NOT TO EXCEED FOR INCLUDING BED AND BOARD. AND AGAIN, THE OWNER OR OPERATORS ARE REQUIRED TO LIVE ON THE PROPERTY SINCE THIS IS A HOME OCCUPATION.

EXPECTED IMPACTS ON ADJACENT ROADWAYS ARE EXPECTED TO BE MINIMAL, THAT THERE WOULD BE LIMITED TRAFFIC AND NOISE FROM GUESTS IF THEY'RE OUTDOORS.

BUT AS YOU SAW, THE SURROUNDING AREA IS EITHER OWNED BY THE PROPERTY OWNER OR TREES OR FARMLAND.

AND THERE'S NOT EXPECTED TO BE A LOT OF PEOPLE ON THERE SINCE THERE'S ONLY UP TO FOUR BEDROOMS CAN BE RENTED, CAN BE USED AT ANY ONE TIME.

AND YOU'RE NOT NECESSARILY GOING TO HAVE ALL OF THOSE OCCUPIED AT THE SAME TIME.

TRAFFIC IS GOING TO BE LIMITED TO PEOPLE COMING IN WHEN THEY WHEN THEY ARRIVE INTO THE ACCOMMODATIONS AND WHEN THEY WHEN THEY LEAVE AND MAYBE WHEN THEY DO SOME TRIPS IN THE SURROUNDING AREA.

THE ZONING ORDINANCE, AGAIN, LIMITS THE NUMBER OF ROOMS TO FOUR.

THERE ARE OTHER TOURISM TYPE USES IN THE AREA, INCLUDING GREENS RACEWAY AND ANOTHER WEDDING VENUE NOT THAT FAR AWAY, WHICH WAS RECENTLY APPROVED. STAFF HAS RECOMMENDED CONDITIONS FOR THE PROPOSED USE, WHICH ARE SIMILAR TO PREVIOUS HOME OCCUPATION, BED AND BREAKFASTS. THE STAFF FINDS THIS TO BE CONSISTENT WITH THE COMPREHENSIVE PLAN.

THE PROPOSED LAND USE WOULD BE LESS INTENSE COMPARED TO OTHER TOURISM USES, WHICH ATTRACT LARGER AMOUNTS OF CUSTOMERS.

AND IT WOULD BE IN KEEPING WITH OUR RURAL CHARACTER TOO.

THE OTHER STAFF REVIEW COMMENTS.

THERE'S A LONG COMMENT FROM THE BUILDING INSPECTIONS DIVISION THAT BASICALLY SAYS THAT WHATEVER IS GOING ON INSIDE THAT STRUCTURE WILL HAVE TO MEET THE BUILDING CODE FOR HAVING GUESTS STAYING OVERNIGHT IN UP TO FOUR ROOMS. THEY'LL HAVE TO PROVIDE PLANS TO THE COUNTY AND THEY'LL BE REVIEWED TO MAKE SURE THEY MEET THE CODE.

THE VIRGINIA DEPARTMENT OF HEALTH COMMENT IS TO TO MAKE SURE THAT THE SEPTIC AND WELL SYSTEM CAN MEET THE NEEDS OF THE ADDITIONAL PEOPLE USING THE FACILITIES ON THE PROPERTY.

AND THE VDOT COMMENTS ARE BASICALLY THAT THE EXISTING INSURANCE THAT'S THERE SEEMS TO BE SUITABLE FOR FOR WHAT IS EXPECTED TRAFFIC WISE.

WELL, NONE OF US FARM ANYMORE.

AND I DON'T RACE ANYMORE BECAUSE MY MOTHER MADE ME STOP WHEN I WAS ABOUT 14.

SO THE NEXT BEST THING WAS TO PURCHASE THE HOUSE AND LIVE IN IT.

AND IT ENABLED HIM TO BE THE FOURTH LARGEST FARMER IN VIRGINIA, PEANUT FARMER.

AND HE RAISED A LOT OF PEANUTS BACK IN THE DAY.

MY FATHER FOLLOWED THE SAME LOGIC SAW EMPTY CORNER OF THE FARM AND SAID, HEY, DAD, CAN I BORROW THAT CORNER FOR A DRAGSTRIP? AND HE WAS LIKE, SURE.
