YOU CAN SEE THE LEGAL DESCRIPTION THAT WE USED IN THE NEWSPAPER.

KEVIN NEAL REQUESTS A SPECIAL EXCEPTION PURSUANT TO THAT ZONING ORDINANCE SECTION TO PERMIT A PRIVATE ANIMAL BOARDING PLACE IN OUR ONE ZONING DISTRICT AND A PRIVATE ANIMAL BOARDING PLACE MEANS A PLACE WHERE FOUR OR MORE DOGS, MORE THAN FOUR MONTHS OLD, ARE KEPT FOR PRIVATE USE.

THE APPLICANT IS REQUESTING KEEP FOUR DOGS ON THE PROPERTY AND A SPECIAL SECTION IS REQUIRED FOR THIS USE.

IF THE DOGS ARE ON A RESIDENTIAL USE PARCEL THAT IS LESS THAN ONE ACRE IN SIZE AND THIS PROPERTY IDENTIFIED WITH THE TAX MAP NUMBER AND THE ADDRESS YOU SEE THERE IS APPROXIMATELY HALF AN ACRE AND ZONED RESIDENTIAL R1.

HERE IS A VIEW OF THE PROPERTY ON A MAP ON ROSEBUD COURT.

LOCATED IN THE NORTHWEST PART OF THE COUNTY SITE CLOSEST TO COLONIAL HEIGHTS.

THE BACKGROUND ON THIS IS IN 2012, THE COUNTY AMENDED THE COUNTY CODE TO LIMIT THE NUMBER OF DOGS ON A RESIDENTIAL USE PARCEL OF AN ACRE OR LESS IN SIZE AND THEN ADDED THIS AS A USE WHICH MAY BE PERMITTED BY SPECIAL EXCEPTION APPROVED BY THE BOARD OF ZONING APPEALS AND ON JUNE 24TH OF THIS YEAR, THE APPLICANT, KEVIN NEAL, SUBMITTED HIS APPLICATION FOR THIS ON THAT PROPERTY.

THE MOST RECENT SIMILAR REQUEST WAS THIS YEAR, ON APRIL 25TH.

I COULD NOT RECALL FOR SURE.

I THINK THAT WAS THE FIRST ONE.

AND CALVIN CARABINE REQUESTED TO KEEP 13 DOGS ON IT JUST UNDER AN ACRE.

THAT REQUEST WAS WITHDRAWN AND BEFORE THE NEXT PUBLIC HEARING SO BASICALLY AT THAT APRIL MEETING THE BZA POSTPONED IT AND POSTPONED A DECISION ON IT TO ALLOW THE APPLICANT TO CONFER WITH HIS ADJACENT NEIGHBORS AND COME TO SOME AGREEMENT ON THAT.

THEY DID NOT NEED TO PROCEED TO THAT NEXT MEETING BECAUSE THE APPLICANT DECIDED TO MOVE OUT OF THE COUNTY SO THEY DID NOT NEED TO GET A DECISION FROM THE BZA ON THAT.

THAT WAS THAT REQUEST WAS FOR 13 DOGS.

THIS APPLICANT'S REQUEST IS FOR FOUR DOGS AND AGAIN, THAT'S ONE MORE THAN WHAT'S ALLOWED BY THE ORDINANCE BY STANDARD AND THE DOGS ARE THREE BEAGLES, ONE-YEAR-OLD, A TEN-YEAR-OLD, A 12-YEAR-OLD, AND ONE POMERANIAN THAT'S EIGHT YEARS OLD.

BEAGLES AND POMERANIANS ARE SMALL DOGS.

THE DOGS ARE PRIMARILY KEPT INDOORS.

REAR YARD IS FENCED ON ALL SIDES AND THE DOGS USE THE BACKYARD FOR LIMITED TIMES DURING THE DAY AND EVENING.

ON THIS VIEW, YOU CAN SEE AN AERIAL VIEW OF THE HOUSE IN THE BACKYARD FENCED-IN.

THERE'S A GARAGE IN THE BACK.

THIS IS A VIEW FROM THE FRONT.

THE HOUSE IS TO THE LEFT AND LOOKING AT THE BACKYARD, THE FENCES AROUND THEIR BACKYARD.

THE STAFF REVIEW COMMENTS, WE JUST NOTED THAT IT'S SINGLE FAMILY HOUSING ON ALL SIDES, SO A SIMILAR STUFF ALL AROUND THIS PROPERTY.

EXPECTED IMPACTS WOULD BE NOISE AND ODOR, BUT THAT'S ONLY IF THE DOGS ARE LEFT OUTDOORS FOR EXTENDED PERIODS OF TIME.

THAT CAN BE MITIGATED BY KEEPING THE DOGS INDOORS PRIMARILY.

THIS APPLICANT HAS SAID THAT, THAT'S WHAT THEY INTEND TO DO AND THERE'S RECOMMENDED CONDITIONS THAT WOULD ENFORCE THAT.

ON A SITE VISIT, I'M FILLING IN FOR ANDRE GREEN HERE.

HE VISITED THE PROPERTY ON AUGUST 8TH AND THE DOGS WERE INDOORS, THE BACKYARD IS FENCED, AND THERE APPEARS TO BE AMPLE SPACE FOR THE DOGS TO PLAY.

THE DOGS DID NOT BARK DURING HIS VISIT, THERE'S NO ODOR NOTICEABLE DURING THE VISIT, AND THE OWNER STATED THAT HE DISPOSED HIS DOG WASTE REGULARLY IN TRASH BIN THAT'S PICKED UP WEEKLY BY THE TRASH COMPANY.

THE PUBLIC NOTICE. OF COURSE, WE ADVERTISED IN THE NEWSPAPER AND WE SENT NOTICES TO ADJACENT PROPERTY OWNERS.

WE ALSO POSTED THE SIGN ON THE PROPERTY.

THERE WERE NO COMMENTS RECEIVED FROM NEIGHBORS PRIOR TO THIS MEETING.

WE DID HEAR FROM ANOTHER BZA MEMBER WHO COULD NOT MAKE IT TONIGHT, MR. KREIDER [NOISE] CALLED IN TO ASK IF THERE WAS ANY CONDITION ON THIS CASE TO REDUCE THE DOGS DOWN TO THREE DOGS IF ANY PASS AWAY.

THERE IS NO CONDITION IN THE RECOMMENDED CONDITIONS THAT WE HAVE.

STAFF THOUGHT THAT FOUR WAS FINE ON THIS PROPERTY CONSIDERING EVERYTHING BUT THAT'S UP TO THE BZA, HOWEVER YOU'D LIKE TO HANDLE THAT ONE.

WHEN WE CONSIDERED THE PREVIOUS REQUEST FOR 13 DOGS THERE WAS A CONDITION.

IF YOU WANTED TO HAVE THAT CONDITION, WE COULD USE THE SAME LANGUAGE THAT BASICALLY IF ONE PASSES AWAY THEY DO NOT REPLACE THAT DOG UNTIL THERE ARE THREE ON THE PROPERTY.

[NOISE] BUT I RECALL FROM SPEAKING TO AN APPLICANT BEFORE HE SUBMITTED HIS APPLICATION HE DIDN'T INTEND TO HAVE MORE THAN THREE DOGS.

BUT THERE'S NOT CURRENTLY A CONDITION FOR THAT ON THIS.

BZA'S CONSIDERATIONS IN MAKING YOUR DECISION.

THERE'S SOME THINGS TO CONSIDER HERE THAT WE'VE OFFERED UP.

YOU CAN EVALUATE THIS REQUEST BASED ON A DEFINITION OF WHAT A SPECIAL EXCEPTION IS.

THIS REQUEST IS A TYPE OF SPECIAL EXCEPTION REQUEST.

THE DEFINITION OF THAT IS IF CONTROLLED AS TO THE NUMBER, AREA, LOCATION OR RELATION TO THE NEIGHBORHOOD, THE USE WOULD PROMOTE THE PUBLIC HEALTH, SAFETY, WELFARE, MORALS, ORDER, COMFORT, CONVENIENCE, APPEARANCE.

BASICALLY THE GENERAL WELFARE OF THE SURROUNDING PROPERTIES.

YOU COULD EVALUATE THE EXTENT TO WHICH THIS PARTICULAR LAND USE IS APPROPRIATE ON THIS PARTICULAR PROPERTY.

YOU COULD EVALUATE IF IT'D BE APPROPRIATE TO CHANGE ANY OF THE RECOMMENDED CONDITIONS IF THAT WOULD MAKE IT MORE FITTING FOR THIS PROPERTY.

STAFF'S RECOMMENDATION SINCE THIS IS A SPECIAL EXCEPTION REQUEST FOR WRITING A RECOMMENDATION, WE RECOMMEND APPROVAL.

OF COURSE AS I MENTIONED THAT THE BOARD COULD CONSIDER IF YOU WANTED TO ADD ADDITIONAL CHANGES TO THE CONDITIONS.

THE RECOMMENDED CONDITIONS ARE ON THE SCREEN HERE.

THIS IS GRANTED TO KEVIN NEAL SPECIFICALLY THAT CURRENT OWNER FOR A PRIVATE ANIMAL BOARDING PLACE FOR THE HOUSING OF FOUR DOGS ON THE PROPERTY WOULD IDENTIFY BY THAT TAX MAP NUMBER, AND THIS APPROVAL WOULD NOT BE TRANSFERABLE TO FUTURE OWNERS OR TENANTS NOR RUN WITH THE LAND SPECIFICALLY FOR THAT PERSON.

THAT'S THE WAY THIS IS WORDED.

ALL DOGS SHALL BE KEPT UNDER APPROPRIATE SUPERVISION WITHIN THE DWELLING, IN THE FENCED AREA, OR LEASHED.

ALL AREAS ASSOCIATED WITH THE DOGS SHALL BE CLEANED AND MADE FREE OF WASTE ON A DAILY BASIS, AND THE PROPERTY OWNERS SHALL DISPOSE OF THE WASTE IN A PROPER MANNER WHICH MINIMIZES ODOR TO THE GREATEST EXTENT POSSIBLE.

NUMBER 4, THIS SPECIAL EXCEPTION MAYBE REVOKED BASICALLY IF THEY DON'T COMPLY WITH THOSE CONDITIONS OR IF THEY DON'T COMPLY WITH SOME OTHER STATE, LOCAL, OR FEDERAL REGULATION.

THOSE ARE THE RECOMMENDED CONDITIONS FOR THIS AND I CAN ANSWER ANY QUESTIONS YOU HAVE.
