MR. WHITTEN BEHIND TAB FOUR IN YOUR PACKETS TONIGHT IS A STAFF RECOMMENDED FEE SCHEDULE UPDATE.

WE ARE RECOMMENDING THAT THE BOARD OF SUPERVISORS AMEND SECTION TWO OF THE COUNTY CODE RELATED TO PLANNING AND ZONING APPLICATIONS.

OVER THE YEARS, THE UPDATES HAVE BEEN DONE TO CERTAIN APPLICATION AND THE CURRENT LANGUAGE IN THE FEE SCHEDULE IS NOT AS AS CLEAR AND AS APPROPRIATE TO MODERN TERMS. FOR SOME OF THESE APPLICATIONS WE'RE SEEING, AS WELL AS SOME OF THE CASES.

AND ALL THE PROPOSED CHANGES ARE INTENDED TO ONLY CLARIFY EXISTING FEES.

NO NEW FEES ARE PROPOSED AND NO INCREASES IN FEES ARE PROPOSED.

THESE ARE JUST NOTES, CLARIFICATION AND REORDERING OF SOME OF THE FEE CATEGORIES, AND NO ACTION IS ACTUALLY REQUIRED BY THE PLANNING COMMISSION BECAUSE THIS FEE SCHEDULE IS IN CHAPTER TWO, WHICH IS ADMINISTRATION.

CHAPTER FOUR, THE COUNTY CODE SO THE BOARD OF SUPERVISORS WOULD ACTUALLY MAKE THE FEE SCHEDULE CHANGE.

HOWEVER, THE BOARD WOULD CERTAINLY APPRECIATE YOUR REVIEW AND CONSENSUS ON APPROVAL OR CHANGES OR MODIFICATIONS TO THIS BEFORE WE TAKE IT TO THE BOARD.

SO I WANTED TO GO THROUGH THE CHANGES WITH YOU AND GIVE YOU SOME EXPLANATION AND CLARIFICATIONS OF WHAT STAFF'S INTENT IS AND THEN ANSWER ANY QUESTIONS YOU MAY HAVE.

AS YOU CAN SEE UNDER SECTION 2-2 FEES, THESE ARE THE FEES THAT RELATE TO PLANNING AND ZONING ITEMS. WE ARE JUST CLARIFYING THE BASE FEE, WHICH IS THE SAME BASE FEE AS WE'VE HAD AND THAT ANY REZONINGS TO PARTICULAR ZONING DISTRICTS ARE AT THE BASE FEE PLUS A FEE PER ACRE.

AND IT'S JUST CLARIFYING IT AND ACTUALLY DELETING SOME OF THE DISTRICTS THAT ARE NO LONGER APPLICABLE EITHER.

DOWN UNDER AMENDMENTS.

WE ARE JUST RELOCATING THE ZONING ORDINANCE AMENDMENT FEE FROM THE BACK PAGE TO THE FRONT PAGE.

WE ARE CLARIFYING THAT A SPECIAL EXCEPTION IS COLLOQUIALLY REFERRED TO AS WELL AS A CONDITIONAL USE PERMIT.

A SPECIAL EXCEPTION TO BZA IS JUST A RELOCATION AGAIN AND THEN THAT THE VARIANCE APPEAL OR ANY OTHER BZA PUBLIC HEARING REQUEST.

JUST CLARIFYING WHAT THINGS CAN GO TO THE BZA.

AS YOU'RE AWARE, SOME NEW ORDINANCES IN OUR COUNTY CODE ACTUALLY REFER CASES DIRECTLY TO THE BZA.

SO THE BZA WILL NOW HEAR MORE THINGS THAN JUST A VARIANCE OR AN APPEAL.

SOME OF THE CHANGES TO THE SITE PLAN PHASE ARE JUST EXPLANATION AND CLARIFICATION OTHER THAN THE AMENDMENT OF THE APPROVED MAJOR SITE PLAN.

THAT'S JUST A SUBCATEGORY AND IT'S A REDUCED FEE FOR THAT.

TYPICALLY NOW YOU WOULD HAVE TO PAY FULL FEE COSTS FOR AN AMENDMENT.

ON PAGE TWO.

THE CATEGORY SITE PLAY AND READ REVIEW WAS JUST LISTED AT 2,500 PER REVIEW.

STAFF HISTORICALLY OVER THE YEARS HAS ALLOWED A FEW REVISIONS BEFORE THIS FEE IS CHARGED AND WE JUST FELT LIKE IT WOULD BE BEST TO CLARIFY THAT,

THAT THAT A NEW FEE DOESN'T APPLY UNTIL THE FORCE SUBMITTAL.

SO IF YOU DO HAVE SEVERAL, YOU HAVE UP TO THREE RE SUBMITTALS BEFORE A NEW FEE IS CHARGED .

ON THE SUBDIVISION PLAT WE DO HAVE RE SUBDIVISIONS AND THAT'S ACTUALLY DEFINED IN IN THE CODE.

SO WE JUST WANT TO CLARIFY THAT THOSE GO UNDER THE SUBDIVISION PLAT REVIEW CATEGORY AS WELL.

AND THEN THE REST OF THE LAST SECTION IS JUST SOME MORE CLARIFICATION LANGUAGE OF WHAT TYPES OF PLATS WE REVIEW.

AND WE CHARGE THE SAME FEE FOR ALL THESE PLATS.

AND THAT DEFERRAL REQUEST FEE IS ONLY CHARGED WHEN AN APPLICANT DEFERS THE REQUEST, NOT THE COMMISSION OR STAFF OR SOME OTHER INCIDENT.

IT'S ONLY CHARGED IF THE APPLICANT REQUESTED THE DEFERRAL.

WE DO NOW ARE REQUIRED TO DO FLOODPLAIN DEVELOPMENT PERMIT REVIEW AND WE RELATE THOSE TO THE FEMA ELEVATION CERTIFICATE.

SO WE JUST WANTED TO CLARIFY THAT THAT'S THE FEE CHARGED FOR THOSE.

UNDER GROUP HOME ZONING REVIEW.

WE DO A RESIDENTIAL COMMERCIAL ACTUALLY GOES THROUGH A DIFFERENT PROCESS.

SO WE WANT TO CLARIFY THAT THIS FEE IS ONLY FOR RESIDENTIAL REVIEW AND THEN ADMINISTRATIVE SECOND DWELLING.

IS THAT'S ACTUALLY LISTED CURRENTLY, TIM, IN THE ZONING ORDINANCE BUT HAD NOT BEEN IN THE FEE SCHEDULE.

SO THIS IS A RELOCATION FROM VERBIAGE IN THE ZONING ORDINANCE TO THE CHAPTER TWO FEE SCHEDULE.

THAT'S ALL THE REVISIONS WE HAD LOOKED AT.

AND THE REQUEST IS FOR AN AUTO REPAIR GARAGE FALLS UNDER THAT LAND USE CATEGORY, BUT IT'S AN AUTO REPAIR GARAGE AND A MOTOR FREIGHT TERMINAL.

AND IT'S PURSUANT TO THE CONDITIONAL ZONING CASE FROM 2003 THAT WAS CALLED ZM 03-002.

THE SUBJECT PROPERTY IS APPROXIMATELY FOUR ACRES IN SIZE.

IT'S LOCATED AT 7901 COUNTY DRIVE AND IT'S IDENTIFIED IT AS THE TAX MAP NUMBER THERE.

AND THE COMPREHENSIVE PLAN FUTURE LAND USE MAP INDICATES IT'S PLANNED FOR RESIDENTIAL USES.

IT'S LOCATED IN BETWEEN COUNTY DRIVE 460 AND THE RAILROAD AND GOLF COURSE DRIVE, EAST OF PUMPHOUSE ROAD. ALL RIGHT.

THERE WAS A BOUNDARY LINE ADJUSTMENT, AND THAT IS WHAT RESULTED IN THERE BEING A FOUR ACRE PROPERTY IN FRONT OF [INAUDIBLE] SEPARATED FROM THAT THAT NINE ACRE PROPERTY ORIGINALLY.

AND THEN FLASH FORWARD SOME MORE YEARS HERE AND YOU END UP RECENTLY THE APPLICANT PURCHASED THE PROPERTY AND HAVE APPLIED FOR THIS SPECIAL EXCEPTION.

THEIR GOALS ARE TO CONSTRUCT A GARAGE WORKSHOP FOR TRUCK REPAIR AND CONSTRUCT AN OFFICE FOR THE TRUCKING COMPANIES USE, JUST OFFICE USE. AND THEY WOULD LIKE TO PARK TRUCKS AND TRAILERS WHEN THEY'RE NOT IN USE ON THE ROAD.

THEY ALSO SAY WANT TO HAVE SOME OUTSIDE STORAGE OF RELATED EQUIPMENT AND TO LEASE PARKING SPACE AREAS TO OTHER MOTOR

CARRIERS, CARRIERS OR OTHER DRIVERS WHO NEED A PLACE TO PARK THEIR TRUCK ON A TEMPORARY BASIS.

SO OFFICIALLY IN THE ORDINANCE LANGUAGE, THE THESE THESE ACTIVITIES FALL UNDER THE AUTO REPAIR GARAGE USE AND THE MOTOR FREIGHT TERMINAL USE, WHICH ARE ALLOWED BY SPECIAL EXCEPTION.

ON THIS SLIDE, YOU CAN SEE A CONCEPTUAL LAYOUT THAT THE APPLICANTS DREW.

YOU CAN SEE NEAREST TO COUNTY DRIVE.

THERE'S I THINK THAT'S THE SMALL OFFICE WHICH WILL THEY'LL BUILD AT A LATER ON IN THEIR TIMELINE IN THE GRAY YOU CAN SEE THEY'RE REPAIR GARAGE THEIR SHOP AND THE GRAY RECTANGLE NEAR THE CENTER OF THE PROPERTY.

AND JUST THEY'VE KIND OF OUTLINED THAT WHOLE INNER PART OF THE PROPERTY AS A PARKING AREA FOR FOR THEIR EQUIPMENT, TRUCKS AND TRAILERS. AND AGAIN, LEASING TO TO OTHERS TO OTHER COMPANIES OR INDIVIDUALS WITHIN THAT SAME AREA.

THIS IS JUST A VIEW FROM THE ROAD, FROM THE FROM GOOGLE.

YOU CAN SEE IT'S A CLEARED LOT.

SO PLANNING AND ZONING COMMENTS JUST NOTING THAT THERE ARE ADJACENT USES.

YOU SAW FROM THE AERIAL VIEW THERE'S TREES ON EITHER SIDE OF THIS LOT, BUT THERE ARE ALSO SINGLE FAMILY HOUSE ON EACH OF THOSE TWO LOTS TO THE EAST AND WEST.

THEY'RE APPROXIMATELY 600 FEET AWAY.

I THINK FROM MEMORY THERE, THE EXPECTED IMPACTS ON ADJACENT PROPERTIES AND ROADWAYS ARE EXPECTED TO BE TRAFFIC, OF COURSE, FROM ENTERING TRUCKS, ENTERING THE PROPERTY FOR THE TRUCK REPAIR AND OCCASIONALLY IN PARKING.

THERE WOULD BE OCCASIONAL NOISE FROM THAT TRUCK TRAFFIC.

AND THIS IS LOCATED ON 460.

SO IT'S NOT GOING TO BE ANY ANYTHING THAT'S OUT OF OUT OF LINE WITH WHAT'S ALREADY GOING ON WITH WITH THE TRUCK TRAFFIC THAT ALREADY EXISTS ON 460.

OF COURSE, THERE WOULD BE VISIBILITY OF THOSE TRUCKS AND TRAILERS AND EQUIPMENT ON THE PROPERTY.

SO TO MITIGATE THE EXPECTED IMPACTS, THERE WILL BE FENCE OR WALL AND SCREENING, VISUAL SCREENING OF WHAT'S GOING WHAT IS ON PARKED ON THE PROPERTY OR STORED ON THE PROPERTY AND IN THE ZONING CONDITIONS STAFF RECOMMENDS TO TO HAVE THE SPECIFIC ACTIVITIES THAT THEY'VE THAT THEY'VE INCLUDED IN THEIR APPLICATION SPECIFIED RATHER THAN IT BEING OPEN ENDED AS LIKE THIS IS A MOTOR FREIGHT TERMINAL AND YOU COULD HAVE ANY NUMBER OF TRUCKS COMING IN AND OUT TRANSFERRING SHIPMENTS BETWEEN TRUCKS AND THINGS LIKE THAT.

THAT'S NOT WHAT THE APPLICANT IS PROPOSED TO DO.

SO THE CONDITIONS WOULD JUST REINFORCE THAT.

STAFF ALSO NOTED THAT ITS OVERALL IS COMPATIBLE WITH THE COMPREHENSIVE PLAN, GIVEN THAT THE CURRENT ZONING IS IS BUSINESS AND IT'S LOCATED ON A MAJOR CORRIDOR WHICH IS USED FOR TRUCKING AND COMMERCIAL RESIDENTIAL, IT'S ALL TYPES OF TRAFFIC.

THE OTHER NOTES ARE THIS THAT IT COMPLIES THIS USE COMPLIES WITH THE CONDITIONS OF THE 2003 ZONING CASE, WHICH SPECIFIED CERTAIN USES THAT WERE ALLOWED THAT ARE THAT ARE ALLOWED IN THIS PROPERTY.

THIS IS THESE ARE SOME OF THEM.

AND THEN JUST THERE'S A NOTE THAT THE SITE PLAN IS REQUIRED.

OTHER STAFF REVIEW COMMENTS CAME FROM BUILDING INSPECTIONS DIVISION.

A WELL IS ALLOWED OR ACTUALLY WILL DEPEND ON THE PROJECTED USAGE, WHICH WILL BE DETERMINED AT A LATER TIME AT THE SITE TIME OF SITE PLAN.

AND THEY NOTED THAT PRIVATE WASTE WATER WOULD BE PERMITTED BECAUSE PUBLIC.

SERVICE LINE IS NOT AVAILABLE TO CONNECT TO.

THE DEPARTMENT OF HEALTH NOTED THAT THE THAT A AN AOC OR P MUST REVIEW THE WATER SUPPLY NEEDS.
